List of themes in relation to the combined seventh to ninth periodic reports of Azerbaijan (CERD/C/AZE/7-9)

Note by the Country Rapporteur

The Committee on the Elimination of Racial Discrimination decided at its seventy-sixth session (A/65/18, para. 85) that the Country Rapporteur would send to the State party concerned a short list of themes with a view to guiding and focusing the dialogue between the State party’s delegation and the Committee during the consideration of the State party’s report. This document contains a list of such themes. This is not an exhaustive list; other issues may also be raised in the course of the dialogue. No written replies are required.

1.The Convention in domestic law, and the institutional and policy framework for its implementation (arts. 1, 2, 4, 6 and 7)

(a)Definition of racial discrimination; prohibition of indirect discrimination; provisions prohibiting and punishing racial discrimination in administrative law (CERD/C/AZE/7-9, paras. 41 and 48-51);

(b)Effectiveness of the legal framework for the prohibition of racial discrimination, and of judicial and non-judicial remedies (CERD/C/AZE/7-9, paras. 32-33);

(c)Implementation of the national plan of action for the protection of human rights, in particular the impact of activities undertaken to protect and further develop the cultural heritage of national minorities and to raise the population’s awareness of the prohibition of discrimination (CERD/C/AZE/CO/6, para. 4 (a)).

2.Situation of minority groups

(a)Information and data on the enjoyment of economic, social and cultural rights by the various ethnic groups in the State party (CERD/C/AZE/CO/6, para. 6; CERD/C/AZE/7-9, paras. 15, 63-65 and 149);

(b)Representation of, and mechanisms for dialogue with, minority groups (CERD/C/AZE/CO/6, paras. 12-13);

(c)Occurrence of racial discrimination and hate speech, including against ethnic minorities (CERD/C/AZE/7-9, para. 32; CERD/C/AZE/CO/6, paras. 9 and 15);

(d)Information on the enjoyment of economic and social rights by internally displaced persons and refugees, including restitution of property (CERD/C/AZE/7-9, para. 170).

3.Situation of non-nationals, including stateless persons, asylum seekers and refugees

(a)Coverage of asylum law and policy, including protection against refoulement and access to economic and social rights (CERD/C/AZE/7-9, paras. 120-121, 141-142 and 167; CERD/C/AZE/CO/6, para. 5);

(b)Impact of the implementation of the national plan of action on combating trafficking in human beings for the period 2009-2013 (CERD/C/AZE/7-9, paras. 125-139);

(c)Measures taken to reduce and prevent statelessness (CERD/C/AZE/7-9, para. 102).
