The Committee on the Elimination of Racial Discrimination decided at its seventy-sixth session (A/65/18, para. 85) that the Country Rapporteur would send to the State party concerned a short list of themes with a view to guiding and focusing the dialogue between the State party’s delegation and the Committee during the consideration of the State party’s report. This document contains a list of such themes. This is not an exhaustive list; other issues may also be raised in the course of the dialogue. No written replies are required.

1.Legal and institutional framework, policies and programmes for implementation of the Convention (arts. 1, 2, 4, 6 and 7)

(a)Measures taken to bring article 176 of the Criminal Code fully in line with the provisions of articles 1 and 4 of the Convention. Steps to establish ethnic or racial motivation as an aggravating circumstance (CERD/C/EGY/17-22, paras. 150 and 152; A/56/18, para. 287);

(b)Updated information on legislative amendments to criminalize acts of discrimination and incitement to hatred and set up a commission to combat discrimination in the light of the provisions of the new Constitution (CERD/C/EGY/17-22, para. 152);

(c)Information on the invocation and application of the provisions of the Convention by the State party’s courts. Updated information on the monitoring of cases of racial or ethnic discrimination in the courts of first instance (CERD/C/EGY/17-22, para. 297; A/56/18, para. 293);

(d)Information on legal provisions on the selection and mandate of the National Council for Human Rights and the human and financial resources at its disposal. Information on support to victims of racial discrimination in accordance with article 99 of the new Constitution. Information on follow-up to the Council’s recommendations to the State party (CERD/C/EGY/17-22, paras. 57-64; A/56/18, para. 292; E/C.12/EGY/CO/2-4, para. 5);

(e)Information on the application of article 75 of the new Constitution, under which, through simple notification, citizens have the right to form organizations, which it endows with a legal personality. Information on the amendment of Act No. 84 of 2002 in accordance with the Constitution. Information on cases of intimidation and arrest of civil society actors (CERD/C/EGY/17-22, paras. 77-79, 178-183, and 287; A/56/18, para. 290);

(f)Updated information on activities relating to teaching, education, culture and information aimed at preventing and combating all forms of racial discrimination. Information on the impact of training sessions for law enforcement personnel on improving the human rights situation (CERD/C/EGY/17-22, paras. 120 and 285; A/56/18, para. 289);

(g)Detailed information on the scope and application of the new antiterrorism law and its compliance with the Convention.

2.Discrimination against ethnic or ethno-religious minorities (arts. 2 and 5)

(a)Demographic data on the ethnic composition of the population and its geographical distribution (CERD/C/EGY/17-22, paras. 15 and 16). Socioeconomic indicators relating to numerically small minority groups, such as nomads, Berbers, Nubians and Egyptians of Greek or Armenian origin (CERD/C/EGY/17-22, paras. 269-279; A/56/18, paras. 286 and 293);

(b)Information on the results of university studies and surveys on small ethnic groups (A/56/18, para. 293);

(c)Updated information on the implementation of the economic and urban development plan for border areas and disadvantaged regions, especially areas in Upper Egypt, Sinai and Nubia, on the basis of article 236 of the Constitution (CERD/C/EGY/17-22, para. 277);

(d)Updated information on the participation of various ethnic groups in political life (CERD/C/EGY/17-22, para. 270);

(e)Information on the State party’s efforts to resettle nomads in modern villages, in particular regarding how the nomads are consulted and their views taken into account (CERD/C/EGY/17-22, para. 271);

(f)Information on measures taken to combat discrimination and violence against religious minorities, including to penalize the destruction of Coptic churches. Information on efforts to promote freedom of religion and religious diversity (E/C.12/EGY/CO/2-4, para. 23);

(g)Information on alleged discrimination against the black community in Egypt;

(h)Information on proceedings in relation to the deadly clashes between tribes in Aswan in 2014. Measures taken to prevent such conflicts and to promote tolerance and diversity.

3.Situation of non-nationals, particularly migrants, refugees and asylum seekers (arts. 5 and 6)

(a)Data on foreigners and their situation in the country (CERD/C/EGY/17-22, paras. 135 and 136; A/56/18, para. 293);

(b)Information on the situation of migrants, asylum seekers and refugees, in particular in relation to access to education, housing, health services and employment. Information on the detention of asylum seekers and cases of refoulement (CMW/C/EGY/CO/1, para. 20; CRC/C/EGY/CO/3-4, para. 76);

(c)Discrimination against migrants, asylum seekers and refugees, in particular those from sub-Saharan Africa;

(d)Information on measures taken to combat trafficking in persons. Efforts to protect foreign workers from abuse, especially domestic workers (CEDAW/C/EGY/CO/7, para. 35);

(e)Situation of refugee and migrant women, victims of multiple forms of discrimination (CEDAW/C/EGY/CO/7, para. 45).
