Implementation of the Convention on the Rights of the Child
List of issues concerning additional and updated information related to the third and fourth combined periodic report of the Czech Republic (CRC/C/CZE/3-4)
T he State party is requested to submit in writing additional updated information , if possible before 28 March 2011 .
The Committee may take up all aspects of children’s rights contained in the Convention during the dialogue with the State party.
Part I
In this section, the State party is requested to submit its responses to the following questions within 30 pages.
1.Please provide details of progress made in the State party’s envisaged re-enactment of the Civil Code to include a specific provision on the right of the child to know his or her biological parents and preserve his or her identity and, in doing so, withdraw its reservation to article 7, paragraph 1, of the Convention.
2.Please provide updated information on the development and/or implementation of a comprehensive national plan of action for the implementation of the Convention.
3.Please indicate if the State party has, pursuant to previously issued and reiterated recommendations of the Committee, established an independent body to monitor the implementation of the Convention.
4.Please provide information on the implementation of a comprehensive national action plan on the prevention of racism, racial discrimination, xenophobia and intolerance in accordance with the Durban Declaration and Plan of Action, and in supplement to the State party’s Anti-Discrimination Act.
5.Please provide details on the criteria, procedure and safeguards for the placement of children in schools of the Framework Education Programme for Children with Light Mental Disabilities.
6.Please provide details about training on the practical implementation of the Convention given to all professionals working with and/or for children, in particular those dealing with institutional care of children and including that of municipal employees tasked with addressing the situation of children placed in institutional upbringing or requiring immediate assistance.
7.Please provide updated information on the steps undertaken to prohibit by law corporal punishment in all settings, including in family and alternative care settings.
8.Please provide details on the effectiveness of State support provided to children with disabilities to be brought up and have their needs fulfilled in a family environment; please also provide information on the Act on Social Services (2006) and its application to children with disabilities who have a single parent and/or unmarried parents.
9.Please provide details on the existing areas of mental health problems and the existing system of mental health services; please also indicate what independent mechanisms are in place for monitoring the provision of these services in accordance with the Convention.
10.Please provide details on whether the views of refugee or asylum-seeking children, including those who are unaccompanied, are taken into consideration during the determination process of their applications for refugee or asylum. Please also indicate if, in addition to legal counselling services provided by NGOs, the State party also provides legal assistance to refugee or asylum-seeking children.
11.Please provide details on the legal definition of “Protective upbringing” contained in the State party’s Juvenile Justice Act, specifying its differences with institutional upbringing and penal detention.
12.Please provide details on the measures undertaken to apply the decisions of the European Court of Human Rights in, inter alia, Wallova and Walla v. the Czech Republic (2006), Kriz v. the Czech Republic and Mezl v. the Czech Republic (2007), and D.H. and Others v. the Czech Republic (2007).
13.Please provide further information on the progress made in implementing the previous recommendations of the Committee on the implementation of the Convention (CRC/C/15/Add.201) and the Optional Protocol to the Convention on the Rights of the Child on the involvement of children in armed conflict (CRC/C/OPAC/CZE/CO/1).
Part II
In this section , the Committee invites the State party to brief ly (three pages maximum ) update the information provided in its report with regard to :
(a)New bills or laws, and their respective regulations;
(b)New institutions (and their mandates) or institutional reforms;
(c)Recently introduced policies, programmes and action plans and their scope and financing;
(d)Recent ratifications of human rights instruments.
Part III
Data, statistics and other information, if available
1.Please provide, if available, statistical data (disaggregated by nationality, age, sex, ethnic origin, geographic location and socio-economic status) for the years 2008, 2009 and 2010 on:
(a)The budgetary allocations for programmes aimed at implementing the Convention or otherwise for the benefit of children;
(b)The number of children deprived of a family environment, and in providing such information, please specify the type of residential care institution, foster home and/or other form of alternative care that these children are placed in;
(c)The number of children who are placed in institutions under the “Protective upbringing” system;
(d)The number of suicides of children;
(e)The enrolment rates at primary and secondary school levels for non-citizen and non-European Union children, including stateless children;
(f)The number, including as a percentage, of cases involving discrimination which received a suspended sentence;
(g)The total number of children with disabilities and the percentage of such children attending regular school;
(h)The number of children that have been placed in schools that are part of the Framework Education Programme for Children with Light Mental Disabilities;
(i)The number of children living in street situations;
(j)The number of child victims of sexual exploitation and trafficking, as well as related prosecutions, convictions and sentences pronounced;
(k)The number of children who are subject to situations of economic exploitation, including that of domestic work and/or other situations.
2.Please update the Committee with regard to any data of the report which may be outdated by more recent data collected or other new developments.
3.In addition, the State party may list areas affecting children that it considers to be important with regard to the implementation of the Convention.
