A.States parties whose initial reports are more than five years overdue
5.At present, there are 29 States parties to the Convention whose initial reports are more than five years overdue. They have been reviewed in three clusters, namely those whose reports were due between 1982 and 1989; those whose reports were due between 1990 and 1994; and those whose reports were due between 1995 and 1998. Only one State party has not reported under any of its treaty requirements.
Cluster one (1982-1989)
6.The following eight States parties from Africa (5) and the Caribbean (3) are in this cluster: Cape Verde, Dominica, Haiti, Guinea-Bissau, Liberia, Saint Lucia, Sierra Leone and Togo.
7.In this group, States have reported most frequently under the International Convention on the Elimination of Racial Discrimination and the Convention on the Rights of the Child. However, almost all of them also have overdue reporting obligations under these as well as other treaties to which they are party. The Committee on the Elimination of Racial Discrimination considered implementation of the Convention in the absence of a report, or the reporting State, in three cases.
8.The specifics are as follows:
(a)Cape Verde has not reported under the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, the International Covenant on Civil and Political Rights or the International Covenant on Economic, Social and Cultural Rights but has reported under the International Convention on the Elimination of Racial Discrimination and the Convention on the Rights of the Child;
(b)Dominica has not reported under the International Covenant on Civil and Political Rights or the International Covenant on Economic, Social and Cultural Rights but has reported under the Convention on the Rights of the Child;
(c)Haiti has not reported under the International Covenant on Civil and Political Rights (a special report was submitted) but has reported under the International Convention on the Elimination of Racial Discrimination and the Convention on the Rights of the Child;
(d)Liberia has not reported under the Convention on the Rights of the Child or the International Convention on the Elimination of Racial Discrimination;
(e)Guinea-Bissau has not reported under the International Covenant on Economic, Social and Cultural Rights but has reported under the Convention on the Rights of the Child;
(f)Saint Lucia has not reported under the International Convention on the Elimination of Racial Discrimination but has reported under the Convention on the Rights of the Child;
(g)Sierra Leone has not reported under the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, the International Covenant on Civil and Political Rights or the International Covenant on Economic, Social and Cultural Rights but has reported under the Convention on the Rights of the Child and the International Convention on the Elimination of Racial Discrimination;
(h)Togo has not reported under the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment or under the International Covenant on Economic, Social and Cultural Rights but has reported under the International Covenant on Civil and Political Rights, the International Convention on the Elimination of Racial Discrimination and the Convention on the Rights of the Child.
Cluster two (1990-1994)
9.The following nine States parties from Africa (3), Asia (2), the Caribbean (2) and Eastern Europe (2) are in this cluster: Bahamas, Bosnia and Herzegovina, Cambodia, Central African Republic, Côte d’Ivoire, Grenada, Latvia, Seychelles and Tajikistan.
10.As with the previous group, States have reported most frequently under the Convention on the Rights of the Child and the International Convention on the Elimination of Racial Discrimination. Apart from non-reporting under the Convention on the Elimination of All Forms of Discrimination against Women, States most commonly seem not to be reporting under the International Covenant on Economic, Social and Cultural Rights. As with the previous group, even though States parties have reported under various treaties, in most instances they also have multiple outstanding reporting obligations. Bosnia and Herzegovina seems to be the only State party that has not reported under any other treaty to which it is a party. In this case, the Human Rights Committee and the Committee on the Elimination of Racial Discrimination considered the situation in the State party without a report under relevant procedures.
11.The specifics are as follows:
(a)The Bahamas has not reported under the Convention on the Rights of the Child, but has reported under the International Convention on the Elimination of Racial Discrimination;
(b)Bosnia and Herzegovina has not reported under the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, the International Covenant on Civil and Political Rights, the International Convention on the Elimination of Racial Discrimination, the International Covenant on Economic, Social and Cultural Rights or the Convention on the Rights of the Child;
(c)Cambodia has not reported under the International Covenant on Economic, Social and Cultural Rights but has reported under the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, the International Covenant on Civil and Political Rights, the International Convention on the Elimination of Racial Discrimination and the Convention on the Rights of the Child;
(d)The Central African Republic has not reported under the International Covenant on Economic, Social and Cultural Rights but has reported under the International Covenant on Civil and Political Rights, the International Convention on the Elimination of Racial Discrimination and the Convention on the Rights of the Child;
(e)Côte d’Ivoire has not reported under the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, the International Covenant on Civil and Political Rights or the International Covenant on Economic, Social and Cultural Rights but has reported under the International Convention on the Elimination of Racial Discrimination and the Convention on the Rights of the Child;
(f)Grenada has not reported under the International Covenant on Civil and Political Rights or the International Covenant on Economic, Social and Cultural Rights but has reported under the Convention on the Rights of the Child;

Cluster three (1995-1998)
12.The following 12 States parties from Africa (6), Asia and the Pacific (5) and Eastern Europe (1) are in this cluster: Botswana, Chad, Comoros, Eritrea, Lebanon, Lesotho, Malaysia, Mozambique, Pakistan, Papua New Guinea, the former Yugoslav Republic of Macedonia and Vanuatu.
13.This group of States parties has most frequently reported under the Convention on the Rights of the Child and the International Convention on the Elimination of Racial Discrimination. In almost all instances where States have reported, new reporting obligations are already outstanding. Several States are party to only one or two other treaties, apart from the Convention on the Elimination of All Forms of Discrimination against Women, and those have commonly adhered to their initial and sometimes subsequent reporting obligations.
14.The specifics are as follows:

(l)Vanuatu has reported under the Convention on the Rights of the Child.
15.While each non-reporting State is unique, those whose initial reports are more than five years overdue seem to share, in general terms, one or more of the following elements: several of them are small island developing States, while others fall into the category of least developed countries; adherence to their reporting obligations seems to be affected by conflict or post-conflict situations. Transition countries are also found among non-reporting States. It should be noted that there are countries among these non-reporting States to which none of these elements apply.
B.States parties whose periodic reports are more than five years overdue
16.States which have submitted their initial report but whose subsequent periodic reports are more than five years overdue fall into three groups.
States whose second (and subsequent periodic) report is overdue
17.Six States from Africa (4), Latin America (1) and Eastern Europe (1) fall into the first category. Their second periodic reports were due between 1992 and 1997. This means that, in all cases, more than one report is overdue. These States are:

Again, this means that in all instances, at least two reports are overdue, and in the case of Guyana, four reports are outstanding. These States are:

States whose fourth (and subsequent) periodic report is overdue
19.The third category comprises 13 States whose fourth (and subsequent) reports are more than five years overdue. These are from Africa (3), Latin America and the Caribbean (5), Asia and the Pacific (3) and Eastern Europe (2). These reports have been overdue since between 1994 and 1997. The fourth periodic reports of six of these States have been overdue since 1994, which means that, in each instance, three reports are outstanding. While Bhutan has submitted its combined initial, second and third periodic report (CEDAW/C/BTN/1-3), which is tentatively scheduled for consideration in January 2004, its fourth to sixth periodic reports are also overdue. The second and third periodic report of Equatorial Guinea (CEDAW/C/GNQ/2-3) has been submitted, but so far, it has not been possible to schedule consideration of the reports, and the fourth and fifth periodic reports are now overdue.
