Consideration of reports of States parties

List of issues in relation to the combined third and fourth periodic reports of Indonesia

The State party is requested to submit in writing additional, updated information, if possible before 1 March 2014.

The Committee may take up all aspects of children’s rights contained in the Convention during the dialogue with the State party.

Part I

In this section, the State party is requested to submit its responses to the following questions (30 pages maximum).

Please update the Committee on the decentralization process and measures taken to coordinate activities and ensure legal consistency across national, regional and local levels. In that regard,please provide specific information on the mechanism referred to in paragraph 6 of the State party’s report. Please also respond to information received that laws issued at the provincial level are sometimes discriminatory to children, in particular regarding access to education and health-care services.

Please provide information on the authority and mandate of the Ministry ofWomen Empowerment and Child Protection (as the coordinating body for the implementation of the Convention) to coordinate and instruct the implementation of child-related action plans and policies with other line ministries.

Please provide information on the mandate of the Indonesian Child Protection Commissionto conduct investigations and to receive and address complaints by children, as well as to follow up on these complaints. In this regard, please update the Committee on the status of the proposed amendment to the Child Protection Law,whichaims to enhance the Commission’s legal standing in child abuse investigation cases.

With reference to the prohibition of discrimination, please provide information on:

(a)Progress achieved in implementing the programmes mentioned in paragraph 32of the State party’s report to close disparities in the enjoyment of children’s rights between rural and urban areas, and results obtained so far;

(b)Legislative and institutional efforts undertaken to eradicate discrimination against girls. Please also refer to raising-awareness measures, if any, taken with a view to eliminating gender stereotyping; and

(c)Measures to end all forms of discrimination against children born out of wedlock, children belonging to the Ahmadiyah faith, Shia followers and Jehovah’s Witnesses, as well asindigenous communities.

Please provide information on any fees charged for birth registration. Please also specify measures taken to overcome ethnic, religious and geographic disparities in birth registration, andexplain the situation ofchildren born out of wedlock, children of asylum seekers, internally displaced children and children of migrant workers with respect to their right to birth registration.

With regard to violence against children, please update the Committee on:

(a)The status of the draft national plan of action for the Elimination of Violence against Children, mentioned in paragraphs41 and 73 of the State party’s report;which governmental body is in charge of its implementation; and what the allocated budgetis;

(b)Progress in implementing the programmes, campaigns and law reform mentioned in paragraph 76, with a view to reducing the incidence of violence against children;

(c)Steps taken to respond to violence by public and private actors against children in vulnerable situations, including children in street situations and children in detention; and

(d)Progress achieved in implementing the National Action Plan to Eliminate Child Commercial Sexual Exploitation, andthe status of the Pornography Bill.

Please provide information on measures taken to put an end to harmful practicesagainst girls, including female genital mutilation, early marriage and polygamy.

With reference to family environment and alternative care, please elaborate on:

(a)The Family Planning Programmementioned in paragraph 83, in particularhow this programme is helping parents tomeet their parental responsibilities;

(b) Measures taken to reduce the number of children placed in institutions and to tackle the phenomenon of poor families sending their children to institutions due to lack of means;and

(c)Steps to disseminate and enforce the institutional care standards adopted by the Ministry of Social Affairs in 2011.

Please provide more information on the number of childrenfrom Timor-Leste who have beenreunited with their parents, and respond to information receivedthat many such children still live in the State party and have not yet been reunited with their parents.

Please indicate the measures taken to ensure the effective implementation of the National Plan of Action for People with Disabilities (2004-2013). Please also describe the steps taken to increase access to schools and medical services for children with disabilities.

With regards to children’s access to health, please inform the Committee of:

(a)Measures taken to improve access to quality health services and safe drinking waterin all provinces,and to reduce geographical disparity in such access. Please also indicate progress made towards achieving the health target indicators mentioned in paragraph 135, particularly with regard to infant, child and maternal mortality target rates;

(b)Steps taken to increase the immunization rateacross all provinces and districts;

(c)Steps taken to ensure access to reproductive health counselling and services for adolescents and to medical services for pregnant adolescents; and

(d) Preventive measures to combat drug abuse by adolescents.

With reference to children’s right to education, please provide information on:

(a)Steps taken to achieve free education at the primary and secondary levelsacross all provinces, particularly in rural areas;

(b)Progress achieved in expanding access to early childhood education and care, particularly for children in rural areas and children belonging to poor families;

(c)Effective measures to tackle school dropout at the secondary level;

(d)Measures to guarantee pregnant teenage girls’ right to education; and

(e)Measures to combat violence in school among children and byteachers.

Please provide information on measures taken to ensure that refugee or asylum-seeking children, particularly those fleeing armed conflict or humanitarian crises, are provided adequate advice, support, legal aid and counselling.

Please provide information on measures to regulate labour carried out by children aged 15 to 17 years. Please update the Committee on the status of the Domestic Workers Protection Bill and describe the measures taken to respond to reports of abuse of child domestic workers, including forced labour. Please also indicate the measures taken to ensure the effective implementation of the National Plan of Action for Eliminating the Worst Forms of Child Labour.

Please provide information on measures taken to reform the juvenile justice system,as mentioned in paragraph 165(a), in order to bring it into compliance with articles 37 and 40 of the Convention. Please also update the Committee on the new draft Criminal Code and draft Criminal Procedure Code and their compliance with the Convention, including their present status.

Part II

In this section, the State party is requested to briefly (three pages maximum) update the information presented in its report with regard to:

(a)New bills or laws, and their respective regulations;

(b)New institutions (and their mandates) or institutional reforms;

(c)Recently introduced policies, programmes and action plans and their scope and financing; and

(d)Recent ratifications of human rights instruments.

Part III

Data, statistics and other information, if available

Please indicate the proportion of the national budget allocated to the implementation of children’s rights and actual expenditure in this area for2011, 2012 and 2013, at national, provincial and district levels. Please also provideinformation on the allocated budget for education and health at national, provincial and district levels for the years 2011–2013.

Please provide updated statistical data, disaggregated by age, sex, geographic location, ethnic origin and socioeconomic background, for the years 2011–2013 on the number of “babies for hire”, rented by their parents for begging activities.

Please provide information on the number of children adopted from 2011 to 2013. Please also provide data on the number of children separated from their families and cared for infoster homes during the years 2011–2013. Please also include information on:

(a)Reasons for the separation;

(b)Type of placements allocated;

(c)Body/organization providing placements; and

(d)Duration of placements and measures to reunite children with their parents.

Please provide statistical data for the years 2011–2013 on the number of children with disabilities in the State party, indicating how many of thesechildren attended school and what type of school.

Please provide data on exclusive breastfeeding rates for the years 2011–2013,disaggregated by age, geographic location, ethnic origin and socioeconomic background of the mother.

Please provide statistical data on the number of children with HIV/AIDS in the State party, for the years 2011–2013, indicating how many have received appropriate healthcare and information.

Please provide statistical data, disaggregated by age, sex, religion, geographic location, ethnic origin and socioeconomic background, for the years 2011–2013 on school dropout and repeat rates atthe primary and secondary levels.

Please provide updated statistical data, disaggregated by age, sex, geographic location, ethnic origin and socioeconomic background, for the years 2011–2013 on the number of children engaged in labour. Please specify how many of these have dropped out of school, and when.

Please provide the Committee with an update onany data in the report which may have been outdated by more recent data collected or other new developments.

In addition, the State party may list areas affecting children that it considers to be of priority with regard to the implementation of the Convention.
