Implementation of the Convention on the Rights of the Child

List of issues concerning additional and updated information related to the consideration of the combined second to fourth periodic report of Angola (CRC/C/AGO/2-4)

The Committee may take up all aspects of children’s rights contained in the Convention during the dialogue with the State party.

The State party is requested to submit in written form additional and updated information, if possible , before 2 August 2010 , not exceeding 30 pages .

Part I

1.Please briefly explain to the Committee how the contents of the new Constitution, which entered into force in February 2010, affect the implementation of the rights of the child set forth in the Convention. Specifically, please inform the Committee how national legislation related to the rights of the child is affected, in particular if legislation on juvenile justice has to be amended (e.g. with regard to the age of criminal responsibility, correctional measures and juvenile courts).

2.Please update the Committee on the current status of the National Action Plan for Children, which was being prepared at the time of submission of the State party’s report. Has the National Action Plan been finalized and adopted? If so, please briefly provide details on its implementation including any obstacles to implementation. If the National Action Plan has not been finalized, please explain why not?

3.Please provide further details on the National Strategy to Prevent and Mitigate Violence against Children, including information on any policies or measures arising from this strategy.

4.Please briefly update the Committee on the results/outcome of the 2005–2009 National Strategic Plan to Accelerate the Reduction in Maternal-Child Mortality in Angola. Please also inform the Committee whether the 2005–2009 National Strategic Plan has been adjusted to cover the 2010–2014 period or if a new plan has been developed.

5.Please inform the Committee whether a mid-term review has been undertaken on the National Education for All plan and, if so, what the results were of this review.

6.Please briefly provide more specific details as to how the Government programme to return and resettle the dislocated populations, refugees, stateless persons and other persons directly affected by the armed conflict impacts on children.

Part II

In this section, the State party is invited to briefly (three pages maximum) update the information provided in its report with regard to:

(a)New bills or laws and their respective regulations;

(b)New institutions (and their mandates) or institutional reforms, and their financing;

(c)Recently introduced policies, programmes and action plans and their scope;

(d)Recent ratifications of human rights instruments.

Part III

Data, statistics and other information, if available

1.In light of article 4 of the Convention, please provide updated data for 2008, 2009 and 2010, on budget allocations (including trends analysis) for the implementation of the Convention throughout Angola in the areas of health, education and protection of children.

2.With reference to children in care, please provide disaggregated data (by sex, age, reason for entry into care and type of placement) for the years 2007, 2008 and 2009 on:

(a)The number of children deprived of a family environment;

(b)The number of children already in the care system;

(c)The number of children who have reached the age of maturity but remain in childcare institutions; and

(d)The average length of stay in the childcare system.

3.Please provide updated data for 2007, 2008 and 2009, disaggregated by sex, age, ethnic group and rural/urban areas, on the number of children:

(a)Infected by HIV/AIDS;

(b)Affected by HIV/AIDS;

(c)Heading households due to HIV/AIDS;

(d)Orphans of HIV/AIDS living in extended families or institutions.

4.Please provide detailed statistics from 2007, 2008 and 2009, disaggregated by age, sex and offence committed, on:

(a)Persons below 18 who have been tried as adults;

(b)Persons below 18 detained in adult penitentiaries;

(c)The number of children in conflict with the law who received alternative penalties;

(d)Reported cases of abuse or ill-treatment of children that occurred during the arrest or detention of children in conflict with the law, as well as the type of follow-up given to these cases.

5.Please provide data for 2007, 2008 and 2009 on:

(a)The number of children victims of sexual exploitation, including prostitution and pornography;

(b)The number of children victims of trafficking;

(c)The number of children victims of sexual abuse, including incest;

(d)The number of children who were provided access to recovery and social reintegration services, specifying the type of services;

(e)Legal proceedings engaged against perpetrators of such offences and the outcomes of those proceedings over the same period; and

(f)The number of child victims of economic exploitation.

6.Please provide data, disaggregated by age, sex and ethnic group on the number of children living and/or working in the street in the State party and the number of them benefiting from social reintegration programmes.

7.Please update the Committee with regard to any data of the report which may be outdated by more recent data collected or other new developments.

8.In addition, the State party may list areas, affecting children that it considers to be important with regard to the implementation of the Convention.
