Note by the Country Rapporteur
1.The Committee on the Elimination of Racial Discrimination decided at its seventy-sixth session (see A/65/18, para. 85) that the Country Rapporteur would send to the State party concerned a short list of themes with a view to guiding and focusing the dialogue between the State party’s delegation and the Committee during the consideration of the State party’s report. The present document contains a list of such themes. It is not an exhaustive list; other issues may also be raised in the course of the dialogue. No written replies are required.
Legal, institutional and public policy framework for combating racial discrimination (arts. 2, 4, 6 and 7)
2.Updated information on the implementation of the National Plan for Good Living 2013-2017 (see CERD/C/ECU/23-24, paras. 9 to 11).
3.Further information on the implementation of the Organic Act on National Equality Councils adopted in 2015 and the establishment of the Council on the Movement of Persons, which focuses on promoting and protecting respect for the principle of equality and non-discrimination in the design of legislation on public institutions (see CERD/C/ECU/23-24, paras. 12 and 13).
4.Updated information on the National Council for the Equality of Peoples and Nationalities and the related National Agenda for the Equality of Peoples and Nationalities (see CERD/C/ECU/23-24, paras. 16 to 18).
5.Updated information on the Plurinational Plan to Eliminate Racial Discrimination and Ethnic and Cultural Exclusion, which, through Executive Decree No. 060, has had the status of State public policy since 2009 (see CERD/C/ECU/23-24, para. 19).
6.Further information on the functioning and impact of the activities carried out by the Citizens’ Observatory as a mechanism for monitoring and following up the effective fulfilment of collective rights (see CERD/C/ECU/23-24, paras. 19 and 20).
7.Measures taken to strengthen policies to combat racism and discrimination and participatory processes used in their formulation (see CERD/C/ECU/CO/20-22, para. 11).
Situation of Afro-Ecuadorians, Montubios and indigenous peoples (arts. 1-7)
8.Further information on special measures taken to combat racism and structural discrimination that affect the enjoyment of economic, social and cultural rights by indigenous peoples, Montubios and Afro-Ecuadorians, particularly access to property, employment, housing, health care and other basic services (see CERD/C/ECU/CO/20-22, paras. 20 to 22).
9.Measures taken to ensure that Afro-Ecuadorian and indigenous children and adolescents have access to education and health services without discrimination.
10.Updated information on the functioning and impact of the activities undertaken by the Council on the Regulation and Development of Information and Communication in relation to combating discrimination in the media.
11.Further information on measures taken to conduct effective processes of prior consultation and guarantee the rights of indigenous peoples faced with the exploitation and commercialization of natural resources in indigenous territory (see CERD/C/ECU/CO/20‑22, paras. 17 and 18).
12.Information on processes of effective prior consultation undertaken with the Shuar Arutam people in relation to the granting of the mining concession for the development of the San Carlos Panantza mining project.
13.Implementation of strategies for the protection of the lives and livelihoods of indigenous peoples living in voluntary isolation (see CERD/C/ECU/CO/20-22, para. 24).

Situation of Afro-Ecuadorian, Montubio and indigenous women
19.The multiple discrimination against indigenous, Afro-Ecuadorian and Montubio women and the measures taken by the State party to combat such discrimination (see CERD/C/ECU/CO/20-22, para. 23).
20.Measures taken to ensure indigenous and Afro-Ecuadorian women’s access in areas such as political participation, education, employment and health, particularly access to both regular and traditional justice by indigenous women.
Access to justice and the fight against racial discrimination (arts. 5 and 6)
21.The administration of criminal justice and the measures taken by the criminal justice system to protect the rights of Afro-Ecuadorian, Montubio and indigenous peoples.
22.Updated information on convictions and sentences handed down in cases of racial discrimination and for alleged hate crimes and the dissemination of information on the domestic remedies available in cases of racial discrimination, the legal avenues available and the individual complaints procedure (see CERD/C/ECU/CO/20-22, para. 18).
23.Further information on strategies for the harmonization of functions, powers and responsibilities of the indigenous justice system and the national justice system (see CERD/C/ECU/CO/20-22, para. 19).
