Please provide disaggregated statistical data (by sex, age groups, and by islands) on infant and child mortality, malnutrition, early pregnancy, sexually transmitted infections (STIs), suicide, drug, alcohol, tobacco and other substance abuse for the years 2003 and 2004 and 2005. Also, please provide numbers of health professionals working in the health-care services for children.

Births

The number of live births that were delivered in all public health facilities in FY 2004/2005 added up to 3567, and 307 or 8.6% of these births were given by teenage mothers.

A number of 249 live births were delivered at home by the Traditional Birth Attendants, so the total number of live births counting multiple births (twins) recorded for both public health facilities and home deliveries is 3816.

The efforts of the MOH to capture as much information from outside the public health facilities had not been so easy, thus the limited details to information that was collected such as the absence of age range of mothers that gave birth at home, which would have presented more enlightening information on teenage pregnancy rates in the whole of Samoa.

SUICIDE

The tables and graphs shown below provide information on the methods used by all the suicide cases that were reported to the national public health facilities, and also the outcome according to sex and age. From the data of FY04/05, a number of suicide cases have declined compared to the past years. Out of the total of 45 reported cases, males account for 57% while females account for 43%.

The age-group accounting for the highest number of suicide cases and is between the age of 15 and 19.

With reference to special protection measures, please provide statistical data (including by sex, age, and by islands) per year for 2003, 2004 and 2005 on the number of:

children sexually exploited, including prostitution, pornography and/or trafficking;

street children and number of children who received assistance;

children victims who received recovery, counselling and other forms of assistance;

children under the age of 15 who are employed, or working; and

children abusing alcohol and using narcotics and drugs and number of children who received assistance.

B. General measures of implementation

1. Please indicate whether the Convention on the Rights of the Child has been invoked directly in domestic courts, and if so, please provide examples of such cases.

The Convention has been invoked many times in criminal matters before both the Supreme and District Courts particularly in closing submissions and sentencing submissions where the Court is requested to consider the Articles of the Convention and how the interests of the child should be one of the primary considerations in passing sentencing.

The Convention is also invoked and applied by the Courts of Samoa in maintenance and affiliation maters, marriage and custody petitions. The Courts of Samoa place much weight on the Convention in these civil matters particularly as our Infants Ordinance puts a statutory obligation on the courts as provided under section 3 of the Infants Ordinance 1961. Section 3 states that:

“Where in any proceedings in Court the custody or upbringing of a child is in question the Court in deciding that question shall regard the welfare of the child as the first and paramount importance”.

In Police v Soolefai Taivale (Sentence) [2000] WSSC 33 (29 September 2000), Justice Vaai (of the Supreme Court of Samoa) stated:

“This court is obliged to impose deterrent sentence to reflect our society’s obligation to protect the interest of children under the Convention on the Rights of the Child ratified in 1994.”

In Police v Howard Masimasi CA 7/99 (27/8/99) a case involving the death of a child at the hands of his father, the Court of Appeal of Samoa, Samoa’s highest Court stated in respect of the Convention of the Rights of the Child:

“All Samoan Courts should have regard to this convention in cases within

its scope.”

2. Please provide information on the activities of the Law Reform Commission and on other measures taken for a comprehensive review of all legislation to ensure compatibility with the Convention.

At the time of writing this report, The Law Reform Commission has not been set up although the Law Reform Commission Act 2002 was passed by Parliament in 2002. In terms of other measures taken to review legislative compatibility with the Convention, the Division for Women took the initiative to utilise the expertise of its Australian Youth Ambassador/ Legal Officer– Ms Penelope Taylor to conduct a Legislative Compliance Review for Samoa in relation to the Convention on the Rights of the Child. The first part of this initiative comprised the development of indicators for the Convention and the second part was the legislative compliance review that was done with the assistance from the Office of the Attorney General. A copy of the list of indicators developed and report on the compatibility of Samoa’s legislations to the Convention is Attachment 1.

It is anticipated that once the Law Reform Commission is established efforts towards reviewing legislations pertaining to children will be advocated for in future. Amendments and/ or development of legislations will focus on the following existing legislations:

the Infants Ordinance 1960 and amendments to date

the Marriage Ordinance 1961

Maintenance and Affiliation Act 1961

Ministry of Women Affairs Act 1990.

Please provide information on the system of data collection and whether it covers all persons below 18 and all areas referred to in the Convention.

The Pacific Children’s Program’s Child Protection Information System contains information on the following risk indicators areas (following the UNICEF cluster framework on child protection and decided upon by the members of the CRC Partnership) from 1986 to 2001;

children not living with biological parents

children not attending school

children working for wages

number of children living in broken homes

Literacy Rate

marital status of the head of household

children living in the urban areas

Access to sanitation

access to water supply

Number of households living below the poverty line.

While the system needs improvement in terms of data collection, the development of indicators and maintenance, it is important to note there is now a Child Protection Information System and that this is the first of its kind in Samoa. One of the priorities for the Pacific Children’s Programme is the work on the Child Protection Information System, so that it captures all the relevant and important information on the protection of children for the purposes pf policy development and planning. It is also timely with the establishment of the Law Reform Commission as we hope the information will be readily available to support needed amendments and new legislations for the protection of children in future.

4. Please provide updated information on the National Coordinating Committee on the Rights of the Child (NCCRC), its mandate, resources and activities, both at national and local levels.

National Coordinating committee is a Cabinet approved committee with 7 members. The committee’s mandate is as follows;

Meet on a monthly basis

Responsible for developing a National Plan of Action for the implementation of the Convention on the Rights of the Child in Samoa.

Ensure that Government implements and honours all ratification obligations under the Convention on the Rights of the Child

To table and recommend to Cabinet through the Minister of Women’s Affairs policy and legislation matters to do with the Convention on the Rights of the child and its implementation.

Each member will receive a sitting allowance as approved within the Ministry of Women Affairs

Activities include in the past year include;

Finalising and endorsement of the country report on the Rights of the Child

Please provide updated information on activities to increase awareness and knowledge of the Convention among the public at large and children and parents in particular and on training programmes for teachers, social workers and other professionals working with/for children.

The Division for Women (DFW) and Pacific Children’s Program (PCP) have been (and continuously) coordinating and implementing a number of awareness activities on the Convention at all levels in Samoa. These activities are implemented through different strategies built on the existing systems and structures and to really work on the mobilization of communities to take the work further. We are also working in close relationship and with collaborative effort with the CRC Partnership/PCP Taskforce and our stakeholders such as Community Based Organizations (CBOs); Village Council, Women’s Committee & Youth Groups through sharing of resources (Human, Technical & Financial) to push the promotion and awareness.

The following are activities undertaken by the DFW & PCP on CRC;

National Children’s Forum (focus on understanding the convention)

Capacity Building training for Stakeholders and CRC Partnership on CRC

Sector Seminar on CRC (We have done seminars for Pre School Teachers Trainees, Pastors wives, Youth Directors and ongoing Village Council Advocacy)

Training workshops for Community Facilitators on the child protection facilitation package (Train-the-Trainers)

Small Grant Scheme for women’s committees/NGOs to coordinate the conduct of activities on the protection of children issues

Conduct Refresher Training of DFW Staff, CRC Partners and Stakeholders on Child Protection Facilitation Package

Produce and Disseminate IEC materials on CRC and child protection for use of sector partners/CBOs

Conduct Multi Media/Public Awareness Campaign on the International Day for Prevention of Child Abuse and Neglect and World Day for the Rights of the Child

Maintain and Update Child Protection Information System. CPIS is used for policy making/activity implementation purposes

Conduct Facilitation Package and Capacity Building processes on CRC and prevention of Child Abuse and Neglect

Support the work of the CRC Partnership/PCP Taskforce and collaborate with NCCRC

Conduct CRC Partnership monthly meetings

Please provide updated information on the cooperation between the State party and the international community including non-governmental organizations, in the efforts to implement the Convention.

The government of Samoa through the Ministry of Women, community & Social Development continues to liase with the international community on the implementation of the CRC in particular UNICEF – which is the managing contractor for the Pacific Children’s Program. UNICEF continues to support the work of the Pacific Children’s Program and has extended the duration of the project to another 4 years in Samoa.

Please indicate the issues affecting children that the State party considers to be priorities requiring the most urgent attention with regard to the implementation of the Convention.

Domestic Violence i.e sexual/incest abuse

Please provide copies of the text of the Convention on the Rights of the Child in all official languages of the State party as well as in other languages or dialects, when available. If possible, please submit these texts in electronic form.

A copy of the translation of the Convention to the Samoan language is attachment 2.

PART III

Under this section, the State party is to briefly (3 pages maximum) update the information provided in its report with regard to:

new bills or enacted legislation;

i)Infants (Adoption) Amendment Act 2005

This came into effect on the Head of State’s assent given on 28 June 2005. It amends the Infants Ordinance 1960 by adding provisions to provide for:

the regulation of adoption agencies carrying out adoption proceedings in Samoa; and

the regulation of ‘overseas adoption’.

ii)Adoption Agency Code of Conduct 2006

The Code of Conduct was made upon signature of the Head of State on 7 March 2006. The Code of Conduct was made pursuant to the Infants (Adoption) Amendment Act 2005

where it is a requirement for the Adoption Agency applying for authorization to carry out adoption proceedings to undertake to comply with the Code of Conduct.

iii)Infants (Adoption) Regulations 2006

These Regulations came into effect on 17 July 2006. The Regulations are made pursuant to the Infants (Adoption) Amendment Act 2005 setting out the requirements for:

an application for the Attorney Generals Certificate authorizing an ‘overseas adoption’; and

a request for authorization to act as an adoption agency.

The procedures to follow to obtain authorization to act as an adoption agency and to carry out an ‘overseas adoption’ are set out in the Regulations.

Legislation currently being drafted

The Attorney General’s Office is involved in the review of the following draft Bills which the relevant Ministries anticipate will be ready for tabling in Parliament by the end of 2006.

Young Offenders Bill

This Bill establishes a Young Offenders Division in the Ministry of Justice, makes provisions for a Youth Offender’s Advocate and sets up a Young Offenders Advisory Panel. The purpose of this Bill is to legislate the separation of court proceedings involving young offenders from the general everyday court and criminal proceedings.

ii) Prisons and Parole Amendment Bill

This Bill aims at separating the parole provisions with regards to young offenders imprisoned upon conviction.

Community Justice and Sentencing Bill

This Bill provides the courts with the sentencing option of ordering the offender to carry out community services under the supervision of community leaders.

Domestic Violence Bill

This Bill provides power for the court to issue protection orders on conditions the court deems fit, in favour of the complainants or victims of domestic violence. It also provides for the Police Service and the Ministry of Justice and Courts Administration to provide assistance to the complainants or victims of domestic violence in instituting proceedings against a perpetrator.
