List of themes in relation to the combined eighth and ninth periodic reports of Uzbekistan (CERD/C/UZB/8-9)

Note by the Country Rapporteur

The Committee on the Elimination of Racial Discrimination decided at its seventy-sixth session (A/65/18, para. 85) that the Country Rapporteur would send to the State party concerned a short list of themes with a view to guiding and focusing the dialogue between the State party’s delegation and the Committee during the consideration of the State party’s report. This document contains a list of such themes. This is not an exhaustive list; other issues may also be raised in the course of the dialogue. No written replies are required.

1.Legislation according to the Convention

The place of the Convention in the legislative system of the State party and relevant examples of cases invoking the Convention;

Incorporation of a definition of racial discrimination into national legislation;

Legislation implementing article 4 of the Convention and cases of application.

2.Institutional framework for the application of the Convention

Competences of different bodies (e.g. ombudsman and the judiciary, parliamentary bodies);

Establishment of a national human rights institution in accordance with the criteria of the Paris Principles;

Membership and activities of the National Centre for Human Rights and the Inter-Ethnic Cultural Centre;

Activities involving non-governmental organizations (NGOs) dealing with human rights issues.

3.Situation of persons belonging to minority groups (Roma, Karakalpaks, Russians, Tajiks, Kyrgyz, Kazakhs and others)

Inter-ethnic relations;

Situation of persons belonging to minority groups, including in the fields of employment, education and health care;

Bodies representing the interests of minority groups and instruments of dialogue;

Competences of the organizations of the Makhala system and of Komolots;

Economic and social situation in the Republic of Karakalpakstan, including measures taken to respond to the environmental disaster of the Aral Sea.

4.Situation of non-citizens: migrants, refugees, asylum seekers and stateless persons

Their status in the country;

Access to employment, education, health care and citizenship;

Groups at risk of being subject to trafficking.

5.Follow-up to Universal Periodic Review (UPR) recommendations accepted by the State party

Measures taken to implement the recommendations relating to the improvement of the mechanism to ensure the effective implementation of the Convention;

Measures taken to implement the recommendations relating to education and training of members of law enforcement bodies and the judiciary in the fields of human rights and the fight against trafficking in women and children.
