List of issues to be taken up in connection with the consideration of the combined third andfourth periodic reports of Slovenia, adopted by the Committee at its pre-sessional working group for the sixty-second and sixty-third sessions (8–12 October 2012)

The State party is requested to submit in writing additional, updated information, if possible before 1February 2013.

The Committee may take up all aspects of children’s rights contained in the Convention during the dialogue with the State party.

Part I

In this section, the State party is requested to submit its responses to the following questions (30 pages maximum).

1.In the context of the March 2012 referendum rejecting a family law bill, please provide updated details on the integration of the provisions of the Convention into the State party’s national legislation.

2.Please provide information on the results and/or assessment of the State party’s plan of action (2009–2010) for the implementation of the Programme for Children and Youth. In doing so, please also provide information on the State party’s mechanism(s) for coordinating the implementation of the Convention.

3.Please provide detailed updated information on the impact of the financial and economic crisis on social protection measures. In doing so, please provide information on steps, if any, taken to safeguard adequate resources for the implementation of the Convention.

4.Please provide detailed information on the role played by the State party’s Children’s Parliament. In doing so, please provide specific information on the extent to which its views are directly taken into account by the State party’s Parliament.

5.Please provide detailed updated information on the State party’s programmes and strategies to eliminate all forms of discrimination against children of ethnic minorities, including Bosniaks and Roma, in particular as regards their right to education and health. In doing so, please also provide details on the results achieved by these programmes and strategies.

6.In the light of the Committee’s previous concern, expressed in 2004, regarding “erased people” (CRC/C/15/Add.230, paras. 26-27) and the decision of the European Court of Human Rights in Kuric and others v. Slovenia (2012), please provide detailed information on measures taken to compensate the children affected by the negative consequences of the “erasure” and ensure that they enjoy all rights under the Convention.

7.Please provide detailed updated information on corporal punishment of children in the State party. In doing so, please also provide information on legislation, if any, prohibiting corporal punishment of children in all contexts.

8.Please provide detailed updated information on the implementation of the State party’s National Programme for the Protection of Mental Health (2009).

9.Please provide detailed and updated information on strategies, programmes and legislation adopted for combating the trafficking of children in the State party. Please also provide information on measures taken for the rehabilitation, reintegration and compensation of child victims of trafficking, sale of children, sexual exploitation and child pornography.

10.With reference to paragraph 357 of the State party’s report, please provide detailed information on the offences for which children can be punished with banishment from the country. In doing so, please also provide details on the children subject to that punishment, and the criteria and safeguards, if any, concerning the imposition of banishment.

Part II

In this section the Committee invites the State party to provide a brief update (no more than three pages in length) on the information presented in its report regarding:

(a)New bills or laws, and their respective regulations;

(b)New institutions (and their mandates) or institutional reforms;

(c)Recently introduced policies, programmes and action plans and their scope and financing;

(d)Recent ratifications of human rights instruments.

Part III

Data, statistics and other information, if available

1.Please provide, if available, statistical data on how many children are living in foster care, disaggregated by sex, age, geographic location and socioeconomic background.

2.Please provide statistical data for the last three years on the conviction rates for non-payment of child maintenance.

3.Please specify the number of children with disabilities, disaggregated by age, sex, geographic location, socioeconomic background and type of disability and covering the last three years:

(a)Living with their families;

(b)Living in institutions;

(c)Placed in foster care;

(d)Attending regular schools;

(e)Attending special schools;

(f)Not attending school.

4.Please provide, if available, statistical data on the number of:

(a)Children who have been victims of ill-treatment and abuse, as well as the number of complaints, investigations, prosecutions and convictions in this regard;

(b)Children who have been victims of sexual abuse and exploitation, including victims of trafficking, as well as the number of complaints, investigations and prosecutions carried out in this regard;

(c)Working children, disaggregated by age, sex, geographic location and socioeconomic background.

5.In addition, the State party may list areas affecting children that it considers to be of priority with regard to the implementation of the Convention.
