Implementation of the Convention on the Rights of the Child

List of issues to be taken up in connection with the consideration of the third periodic report of Tunisia (CRC/C/TUN/3)

The following questions concern issues which the Committee considers to be of high priority and on which supplementary information is requested. Further questions regarding the implementation of the Convention may be asked during the dialogue with the State party.

Part I

Under this section the State party is requested to submit in written form additional and updated information, if possible before 6 April 2010.

1.Please indicate whether an evaluation of the National Plan of Action for Children (2002–2011) has been carried out, whether the established goals were reached and what difficulties were encountered. Will the plan be extended and, if so, in what manner?

2.Please provide information on the role, the make-up and the independence of the Information, Training, Documentation and Studies Observatory on the Protection of the Rights of the Child. Please indicate whether new child protection indicators have been developed by the Observatory and whether an integrated data collection system has been implemented and applied at the national, regional and local levels.

3.Please indicate whether the State party plans to eliminate provisions concerning inheritance rights that are discriminatory against girls (art. 104 of the Code of Personal Status). Please also indicate whether adopted children and children born out of wedlock whose parentage has been proven by DNA testing enjoy equal treatment in regard to inheritance.

4.Please indicate what measures the State party has taken to “ensure the full practical implementation of the rights to freedom of expression and freedom of association and peaceful assembly”, as recommended by the Committee in its previous concluding observations (CRC/C/15/Add.181).

5.Please provide information on the scale of physical and psychological violence against children, in particular corporal punishment, sexual abuse and gender-based violence within the home, in schools, in detention centres and in institutions.

6.Please inform the Committee of the number and present situation of children who have dropped out of school at the basic education level in the last three years. Are there mechanisms for their reintegration or intermediary means of allowing these children to acquire the necessary skills to eventually take part in a vocational training programme?

7.Please describe the existing alternatives to the deprivation of liberty and indicate whether the State party plans to create the post of probation officer as outlined in the Child Protection Code. Please also inform the Committee about the conditions in juvenile and pretrial detention facilities and indicate whether a strict separation between juveniles and adults is ensured in pretrial and other detention facilities.

8.Please indicate the issues relating to children that the State party considers to be priorities requiring its most urgent attention with a view to the implementation of the Convention.

Under this section, the State party is invited to briefly (three pages maximum) update the information provided in its report with regard to:

New bills or enacted legislation

New institutions and their primary functions

Newly implemented policies

The main plans and programmes of action that have recently been undertaken and their scope

Newly ratified human rights instruments

Part III

Data and statistics, if available

1.Please provide an analysis of the trends in budget allocations (in absolute figures and percentages of the national and regional budgets) for the implementation of the Convention with reference to education, health, social services and child protection for 2008, 2009 and 2010.

2.Please provide comparative data for 2007, 2008 and 2009 (disaggregated by sex, geographical location and age) on the number of child victims of sexual exploitation, including prostitution, pornography, trafficking and sale, and the number of these children who have had access to rehabilitation and social reintegration services.

3.Please provide comparative data for 2007, 2008 and 2009 (disaggregated by sex, geographical location and age) on the number of children who have been economically exploited, including children employed to perform domestic work or other high-risk tasks, and on the number of street children in urban and rural areas.
