List of themes in relation to the combined nineteenth and twentieth periodic reports of Italy

Note by the Country Rapporteur

1.The Committee on the Elimination of Racial Discrimination decided at its seventy-sixth session (see A/65/18, para. 85) that the Country Rapporteur would send to the State party concerned a short list of themes with a view to guiding and focusing the dialogue between the State party’s delegation and the Committee during the consideration of the State party’s report. This document contains a list of such themes. It is not an exhaustive list; other issues may also be raised in the course of the dialogue. No written replies are required.

The Convention in domestic law and the institutional and policy framework for its implementation (arts. 1-4)

2.Detailed information on domestic legislation prohibiting racial discrimination in accordance with the definition contained in article 1 (1) of the Convention, including prohibition of discrimination against non-citizens (CERD/C/ITA/CO/16-18, para. 12; CERD/C/ITA/19-20, paras. 12-16).

3.Updated information on the establishment of a national human rights institution in accordance with the principles relating to the status of national institutions for the promotion and protection of human rights (the Paris Principles) (CERD/C/ITA/CO/16-18, para. 13; A/HRC/28/4/Add.1, para. 1).

4.Information on measures taken to ensure the independence of the National Office against Racial Discrimination (CERD/C/ITA/CO/16-18, para. 14).

5.Updated information on the plan against racism, xenophobia and related intolerance, and progress achieved so far (CERD/C/ITA/19-20, para. 8; A/HRC/28/4/Add.1, para. 1).

6.Systematic and coherent data collection system concerning racially discriminatory offences, including complaints filed, prosecutions launched and sentences passed, in order to monitor progress over time.

Racist hate speech and hate crimes (art. 4)

7.Detailed information on specific legislative provisions that prohibit the dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination or acts of violence, and organizations that promote and incite racial discrimination, in accordance with article 4 of the Convention (CERD/C/ITA/CO/16-18, para. 17; CERD/C/ITA/19-20, paras. 22-24 and 59).

8.Racism in political discourse; prosecution of politicians for discriminatory statements (CERD/C/ITA/CO/16-18, para. 17; CERD/C/ITA/19-20, para. 70).

9.Impact of measures taken to combat racial stereotypes and bias in the media, on the Internet and among the public at large (CERD/C/ITA/CO/16-18, para. 17; CERD/C/ITA/19-20, paras. 37-40).

10.Impact of measures taken to combat racism in sports (CERD/C/ITA/19-20, paras. 25 and 26).

Discrimination against ethnic minorities (arts. 2–7)

11.Disaggregated data on the ethnic composition of the State party (CERD/C/ITA/CO/16-18, para. 11).

12.Updated information on the situation of Roma, Sinti and Camminanti populations, particularly with regard to access to basic facilities such as health care services and education; information on the provision of effective remedies to individuals whose rights were violated as a result of the implementation of the Nomad Emergency Degree; results achieved to date through the implementation of the National Strategy for Roma Inclusion, 2012-2020 (CERD/C/ITA/CO/16-18, paras. 15, 20 and 21; CERD/C/ITA/19-20, paras. 175-181).

13.Information on the representation of ethnic minorities in the executive branch, the parliament, political parties, the police force, the criminal justice system and other public bodies, including the public broadcasting sector.

14.Updated data on access to housing and on rates of homelessness, disaggregated by ethnicity (CERD/C/ITA/19-20, para. 145).

15.Situation of ethno-religious minorities, in particular Muslims; information on recent measures adopted to combat discrimination against and to foster dialogue with Muslim communities in the light of recent terrorist attacks across Europe and the potential of increased discrimination against Muslims.

16.Information on the situation of second and third generation immigrant communities from Africa, particularly Eritrea, Ethiopia and other East African countries.

Situation of non-citizens, including migrants, asylum seekers, refugees and stateless persons (arts. 5 and 7)

17.Updated information on the human rights situation of asylum seekers and migrants, including access to social services and employment; conditions of reception centres (CERD/C/ITA/CO/16-18, paras. 22 and 23; CERD/C/ITA/19-20, paras. 134 and 160).

18.Respect for the principle of non-refoulement in practice (CERD/C/ITA/CO/16-18, para. 22; CERD/C/ITA/19-20, para. 158).

19.Updated information on the human rights situation of refugees and stateless persons, including access to education, housing, health services and employment.

Access to justice (art. 6)

20.Concrete measures adopted to address the underreporting of cases of racial discrimination and their impact (CERD/C/ITA/CO/16-18, para. 25; CERD/C/ITA/19-20, para. 20).

21.Information on remedies provided to victims of racial discrimination, including in cases of racist hate speech and hate crimes (CERD/C/ITA/CO/16-18, para. 25; CERD/C/ITA/19-20, paras. 78, 123).

22.Information on cases of exploitation and forced labour of migrants and their outcomes, including prosecution, conviction and remedies provided to victims (CERD/C/ITA/CO/16-18, para. 23; CERD/C/ITA/19-20, paras. 136-142).

Training, education and other measures to combat prejudice and intolerance (art. 7)

23.Information on the provision of systematic and specialized training for government officials, members of the judiciary and law enforcement officials on the international obligations of the State party under the Convention (CERD/C/ITA/CO/16-18, para. 26).

24.Measures taken to assist second-generation migrant children and youth in retaining their mother tongue and promoting their cultural traditions (CERD/C/ITA/19-20, para. 199).

25.Further information on steps taken to include, in school curricula and in the training curricula of teachers and other professionals, programmes and subjects to help promote human rights issues which would lead to better understanding, tolerance and friendship among all groups (CERD/C/2007/1; CERD/C/ITA/19-20, paras. 196-199).
