OPTIONAL PROTOCOL ON THE SALE OF CHILDREN, CHILD PROSTITUTION AND CHILD PORNOGRAPHY

List of issues to be taken up in connection with the consideration

of the initial report of LITHUANIA (CRC/C/OPSC/LTU/1)

The State party is requested to submit in written form additional and updated information, if possible, before 8 August.

1.Please provide, if available, statistical data (including by sex, age, urban/rural areas and ethnic or social origin) for the years 2005, 2006, and 2007 on the following:

The number of reported cases of sale of children, child prostitution and child pornography, with additional information on type of follow-up provided on the cases, including prosecution, withdrawals, sanctions for perpetrators and compensation to victims;

The number of children trafficked to and from Lithuania as well as within the country for the purpose of sexual exploitation;

The number of child victims provided with recovery assistance and compensation as defined in article 9, paragraphs. 3 and 4 of the Optional Protocol.

2.Please provide a brief update on the implementation of the Programme for the Prevention and Control of Trafficking in Human Beings for 2005-2008and indicate whether the State party has or intends to have a specific plan of action in relation to the sale of children, child prostitution and child pornography, and if so, please provide most relevant information on the competent authorities responsible for their implementation and monitoring.

3.Please provide the definitions of sale of children, child prostitution and child pornography under the Lithuanian Criminal Code and indicate if they are in line with the definitions in the Optional Protocol.

4.Please indicate if there is any legal provision that would allow for prosecution of a child involved in sale, prostitution or pornography, and, if so, under which conditions.

5.Please provide information on specific budget allocations (national, regional and local) for the implementation of the provisions of the Optional Protocol, including on budget allocated to ensure social reintegration and physical and psychosocial recovery for child victims of offences covered by the Optional Protocol and information on the number of children served.

6.Please provide further information on the training for specialists working with children who have suffered sexual abuse,commissioned by the Ministry of Social Security and Labour and inform the Committee of the number of specialists in this field.

7.Please provide brief updated information on the outcome of the investigation undertaken by the Office of the Ombudsman for the Protection of the Rights of the Child on the issue of sale of children, child prostitution and child pornography, on the “working group” to regulate activities of Internet cafes and computer games and on any responses to its recommendations.

8.Please indicate efforts by the State party to strengthen the capacity of local authorities in the implementation of this Optional Protocol.

9.Please provide information, if any, on specifically targeted preventive measures that have been put in place for particularly vulnerable children, such as Roma children, street children and children residing in institutions such as orphanages, boarding schools and similar settings.

10.Please provide information on the recently adopted National Family Policy and its expected effect on families and children impacted by the Protocol.
