IMPLEMENTATION OF THE CONVENTION ONTHE RIGHTS OF THE CHILD

List of issues to be taken up in connection with the considerationof the second periodic report of Chad (CRC/C/TCD/2)

Part I

Under this section the State party is requested to submit additional and updated information in writing, if possible before 24 November 2008

1.Please give additional details on activities relating to the recommendations made in the Committee’s previous concluding observations (CRC/C/15/Add.107) on the initial report of Chad (CRC/C/3/Add.50) which have not been completely followed up, in particular with regard to the allocation of resources, the situation of girls, registration of births, adoption, health of adolescents, juvenile justice and child labour.

2.Please give information on the proportion of State revenue, notably that derived from the sale of oil, allocated to children through the social services, education services, health care and social security.

3.Please give details on the current state of legislation which protects children (draft code of protection of the child, draft code of persons and the family, Criminal Code, ratification of the 1993 Hague Convention on Protection of Children and Cooperation in respect of Intercountry Adoption, and ratification of the Palermo Protocol.

4.Please give updated information on the proposal by the Prime Minister’s Office to establish a committee to supervise implementation of the Convention.

5.Please provide information on reforms undertaken or envisaged in the civil registration system and, in particular, to ensure the systematic registration of births throughout the country.

6.Please briefly describe, with examples where possible, cooperation between the State party and civil society in the area of the rights of the child.

7.Please briefly inform the Committee of any initiatives undertaken, including new legislation, to combat harmful practices, such as children being accused of witchcraft, early or enforced marriages and “mouhadjirin” children, which violate children’s rights.

8.Please indicate the questions relating to children which the State party considers as having priority and urgently requiring attention with a view to the implementation of the Convention.

Part II

In this section the State party is requested to briefly (three pages maximum) update the information provided in its report concerning:

New bills or legislation

New institutions

Newly implemented policies

Newly implemented plans of action, programmes and projects, and their scope

Part III

Data and statistics, if available

1.In the light of article 4 of the Convention, please provide for the years 2007 and 2008 data on budgetary appropriations (in absolute figures and as percentages of the national budget or gross domestic product) allocated to implementation of the Convention throughout the country in the areas of education and health.

2.With reference to children deprived of a family environment and separated from their parents, please provide disaggregated data (by sex, age group and urban or rural area) for the years 2005, 2006 and 2007 on the number of children:

(a)Separated from their parents;

(b)Placed in an institution (give the number of institutions in the country);

(c)Placed with foster families;

(d)Adopted within the country or abroad.

Part IV

The following is a preliminary list of major issues (other than those already covered in part I) that the Committee intends to take up during the dialogue with the State party. They do not require written answers. This list is not exhaustive as other issues may be raised in the course of the dialogue.

1.The State party’s strategy to significantly strengthen the overall implementation of the Convention, with particular attention to the general principles of the Convention, including article 3 (best interests of the child) and article 12 (respect for the views of the child).

2.Legislation and customary law (including the concept of dia).

3.Definition of the child (customary law).

4.The right to life, survival and development (Strategy for Promoting Children’s Survival and Development - SASDE).

5.Family environment (support/assistance provided by the State for parents).

6.Children deprived of their family environment (reception centres and institutions, and adoption).

7.Violence against children, including corporal punishment.

8.Children with disabilities (integration into society, accessibility of installations).

9.Health (including access to health care, financial accessibility of health care, vaccinations, harmful traditional practices, health of adolescents and mental health).

10.Education (including the existence of qualified teachers and adequate facilities, access of young girls to education, additional educational fees, and geographical disparities in access to education).

11.Child soldiers (demobilization, reintegration into their communities and reunification with their families).

12.Refugee children.

13.Street children.

14.Economic exploitation, including child labour (worst forms of child labour, “mouhadjirin” children, “drover” children, child servants and reform of Decree No. 55/PR/PM‑MTJS‑DTMOPS).

15.Sexual exploitation of, and trafficking in, children (non-criminalization of child victims).

16.Administration of juvenile justice (including alternative measures to detention, conditions in juvenile detention centres, and reform of the juvenile justice system).
