يوم المناقشة العامة

التكلم والمشاركة واتخاذ القرار - حق الطفل في أن يستمع إلى آرائه

مخطط عام

1- ستكرس لجنة حقوق الطفل ي وم المناقشة العامة السنوي الذي ستعقده في 15 أيلول/سبتمبر 2006 أثناء دورتها الثالثة والأربعين لموضوع "التكلم والمشاركة واتخاذ القرار- حق الطفل في أن يستمع إلى آرائه". ولقد قررت اللجنة تناول هذا الموضوع في دورتها الأربعين (12-30 أيلول/سبتمبر 2005) عملاً بالم ادة 75 من نظامها الداخلي.

2- والغرض المنشود من أيام المناقشة العامة هو التشجيع على تفهم مضمون الاتفاقية والآثار المترتبة عليها تفهماً أكبر في سياق بعض المواد أو المواضيع المعينة. وتعتمد اللجنة توصيات بعد إجراء المناقشة آخذة في الاعتبار المسائل المطروحة. وي ُدعى ممثلو الحكومات، وآليات الأمم المتحدة لحقوق الإنسان، وهيئات الأمم المتحدة ووكالاتها المتخصصة، والمنظمات غير الحكومية، والمؤسسات الوطنية لحقوق الإنسان، فضلاً عن الأطفال والخبراء بصفتهم الشخصية، إلى حضور الاجتماعات.

نهج يوم المناقشة العامة وأهدافه

3- ركز ت اللجنة باستمرار، لدى النظر في تقارير الدول الأطراف المقدمة بشأن تنفيذ اتفاقية حقوق الطفل، على أهمية حق الطفل في التعبير عن آرائه في جميع الأمور التي تمسه، مع إيلاء تلك الآراء الاعتبار الواجب وفقاً لسن الطفل ونضجه. وعينت اللجنة هذا الحق بوصفه مبدأ من المب ادئ العامة الأربعة المكرسة في الاتفاقية. وذلك يعني أن تنفيذ المادة 12 وتنفيذ المواد الأخرى من الاتفاقية كلّ لا يتجزأ وأن الحق المكرس في تلك المادة هو حق من حقوق الطفل قائم بذاته في الوقت نفسه.

4- ولذلك فالغرض المنشود من يوم المناقشة العامة هو:

- بحث مغزى ا لمادة 12؛ وصلتها بالمواد الأخرى (ولا سيما المواد 3 و6 و9 و10 و11 و13 و15 و16 و19 و20 و22 و30 و31)، وبحث ما يترتب عليها من أثر في مشاركة الأطفال - مشاركة فردية وجماعية - في جميع جوانب حياة المجتمع؛

- التركيز على تعيين ما يوجد من نواقص وممارسات حميدة ومسائل تتسم بالأولوية مما يجب تناوله لكي يتمتع الطفل بحقه في أن يستمع إلى آرائه وفي أن تؤخذ تلك الآراء في الاعتبار تمتعاً أكبر بصورة مطابقة لأحكام الاتفاقية؛

- تشجيع مشاركة الطفل وتعزيز الفرص المتاحة ل‍ـه على جميع المستويات، في البيت، والمدرسة، والمجتمع المحلي و المجتمع بمعناه الواسع، وكذلك في حالات الطوارئ وأثناء النـزاعات وبعدها.

5- وقررت اللجنة، تيسيراً لمناقشة تلك المسائل مناقشة متعمقة، إنشاء فريقين عاملين يركزان على الموضوعين الفرعيين التاليين:

الفريق الأول: حق الطفل في أن يُستمع إلى آرائه في الإجراءات القضائ ية والإدارية

6- سيركز هذا الفريق على حق الطفل الفردي في أن يُستمع إلى آرائه في أي إجراءات قضائية أو إدارية تمسه على النحو المنصوص عليه في المادة 12. وقد تتصل تلك الإجراءات بالقانون المدني والجنائي أو بمسائل الأسرة والرعاية البديلة، والحماية، والصحة، وشؤون الهجرة، والدراسة، ضمن أمور أخرى. وسيقوم الفريق العامل، بصفة خاصة، بتوضيح كيفية إعمال هذا الحق في الوقت الحاضر وتحديد العقبات الرئيسية التي تعوق إعماله وما إذا كان يجب وضع معايير خاصة. كما سيتناول أسئلة معينة تشمل ما يلي:

- ما هي الآليات والتدابير العملية ا لتي يجب وضعها لإتاحة الفرصة للأطفال كي يُستمع إلى آرائهم بصورة ملائمة ومعقولة؟ وما هو التدريب اللازم ومن هي الجهات المستهدفة به؟

إلى أي مدى يشمل حق الطفل في أن يُستمع إلى آرائه في الإجراءات القضائية أو الإدارية حقه في أن يبلغ بالقرارات المتخذة وبتنفيذ تلك القرارات؟ وهل يمكن للطفل أن يتنازل عن حقه في أن يُستمع إلى آرائه؟

- مَن هي الجهة التي تحدد متى يمكن اللجوء لتلك الآليات لضمان حق الطفل في أن يُستمع إلى آرائه، وكيف تولى "آراء الطفل الاعتبار الواجب وفقاً لسنه ونضجه"، وعلى أيّ أساس؟

- هل تلزم أية إجراءات مح ددة وأحكام قانونية لضمان حق الطفل في أن يُستمع إليه كشاهد في دعوى قانونية؟ وإذا كان الأمر كذلك، فما هي التدابير التي ينبغي الأخذ بها؟ وهل تختلف الأحوال في هذا الصدد إن كانت الدعوى مدنية أم جنائية؟ وإن اختلفت، فما هو وجه الاختلاف؟

- هل يجب تحديد معايير دنيا لممارسة حق الطفل في أن يستمع إلى آرائه في الإجراءات القضائية والإدارية، وكيف يمكن تطبيق تلك المعايير فـي حـالات الطوارئ وأثناء النـزاعات وبعدها؟

الفريق الثاني: الأطفال كمشاركين نشطين في المجتمع

7- سيركز هذا الفريق على حق الطفل في التعبير عن رأيه في أطر شت ى، كالأسرة والمدرسة والجمعيات والشؤون السياسية، وحقه في المشاركة بنشاط في عملية اتخاذ القرار في تلك الأطر. وتتسم المادتان 13 و15 من الاتفاقية بأهمية خاصة في هذا السياق. وسيتناول الفريق العامل الأطفال باعتبارهم أفراداً وباعتبارهم مجموعة محددة. كما سيسعى لمع رفة الوضع الحالي لهذا الجانب الأوسع من جوانب مشاركة الطفل في المجتمع، ولتعيين العقبات الرئيسية التي تعوق مشاركة الطفل بنشاط، وتحديد سبل المضي قدماً. وسيأخذ في الاعتبار أثر الحركات الاجتماعية في تعزيز حق الطفل في أن يُستمع إلى آرائه. وتشمل الأسئلة التي سيتن اولها ما يلي:

- كيف شارك الأطفال بنشاط في المجتمع (أمثلة ملموسة) وما هو تقييمهم لهذه المشاركة؟

- كيف ومتى يمكن أن تتحول مشاركة الأطفال المباشرة من مجرد استشارة إلى شراكة نشطة؟ وكيف ومتى يمكن تعبئة الأطفال لكي يبادروا إلى اتخاذ إجراء أو إطلاق مشروع؟

- ما هي الآليات التي يمكن أن تُنشأ لتشجيع مشاركة الأطفال في المدارس والجمعيات والمجتمع؟

- كيف يمكن تقييم فعالية مشاركة الأطفال؟

- كيف يمكن تهيئة بيئة مؤاتية لتمكين الأطفال من المشاركة؟

- هل ينبغي منح المجموعات والمنظمات التي يترأسها الأطفال والشباب مركزاً قانونيا ً أو الاعتراف بها قانوناً؟

- هل ينبغي تمكين الأطفال من المشاركة الكاملة في العمليات السياسية قبل إتمام الثامنة عشرة من العمر؟

8- يوصى، حيثما أمكن، بإدراج الأطفال ومنظماتهم/شبكاتهم كمشاركين في يوم المناقشة العام ة.

المشاركة في يوم المناقشة العامة

9- أيام المناقشة العامة هي اجتماعات سنوية عامة يُدعى إليها ممثلو الحكومات، وهيئات الأمم المتحدة ووكالاتها المتخصصة، والمؤسسات الوطنية لحقوق الإنسان، والمنظمات غير الحكومية، بما فيها الجماعات الشبابية وكذلك الخبراء بصفتهم الشخصية. وسيعقد الاجتماع خلال الدورة الثالثة والأربعين للجنة في مقر مفوضية الأمم المتحدة السامية لحقوق الإنسان (قصر ويلسون، جنيف) يوم الجمعة، 15 أيلول/سبتمبر 2006.

10- ويراد من شكل تنظيم يوم المناقشة العامة تمكين المشاركين من تبادل الآراء في إطار حوار صريح ومفتوح. لكن، وبسبب القيود الزمنية المفروضة، تطلب اللجنة إلى المشاركين تفادي الإدلاء ببيانات رسمية يوم المناقشة العامة. وترحب اللجنة بتقديم مساهمات خطية عن المسائل والمواضيع المشار إليها، ضمن الإطار المبين أعلاه. كما يهم اللجنة، بصفة خاصة، تلقي معلومات (من الأطفال أيضاً) بشأن الصعوبات الرئيسية، والممارسات الحميدة، والمجالات التي يمكن فيها اتخاذ إجراء بخصوص مشاركة الأطفال في الفريقين العاملين وطرائق تنفيذ هذا الإجراء.

النتائج المتوقعة

12- ستعتمد اللجنة توصيات على أساس العروض المقدمة عن الموضوع ومداولات الفريقين العاملين. ويُتوقع أن يسمح يوم المناقشة العامة والتوصيات التي سيتمخض عنها بتعيين مسائل محددة وشواغل رئيسية ينبغي التعمق في دراستها، كما يُتوقع أن يتيح مدخلات يستفاد منها في صياغة تعليق عام على المادة 12، وهو ما تعكف عليه الآن اللجنة بالتعاون مع منظمة الأمم المتحدة للطفولة (اليونيسيف).
