IMPLEMENTATION OF THE CONVENTION

ON THE RIGHTS OF THE CHILD

List of issues to be taken up in connection with the consideration of the second and third periodic reports of the Republic of Moldova (CRC/C/MDA/3)

Under this section the State party is requested to submit in written form additional and updated information, if possible by 24 November 2008

Part I

Please provide a brief update on the Ministry of Social Protection, Family and Child (created in 2007), particularly on its mandate, composition, activities, financial and human resources and on its coordination with other public authorities responsible for protecting the rights of children, including the National Council for Child Rights Protection.

Please provide further clarification on the provisions of the Family Code and Civil Code, referred to in paragraph 4 of the State party’s report, that have been amended to incorporate the provisions of the Convention.

Please indicate whether the Convention on the Rights of the Child has been invoked or referred to directly in domestic courts, and if so, please provide examples of such cases.

Please provide brief information on the National Plan to Prevent and Combat Trafficking in Human Beings, referred to in paragraph 39 of the State party’s report.

Please briefly describe, including through examples if possible, the cooperation between the State party and civil society in the field of child rights.

Please indicate the issues affecting children that the State party considers to be priorities, requiring the most urgent attention with regard to the implementation of the Convention.

Part II

Under this section, the State party is invited to briefly (three pages maximum) update the information provided in its report with regard to:

New bills or enacted legislation;

New institutions;

Newly implemented policies; and

Newly implemented programmes and projects, and their scope.

PART III

Data and statistics, if available

In the light of article 4 of the Convention, please provide disaggregated data for the years 2006, 2007 and 2008 on budget allocations (including trend analysis) regarding the implementation of the Convention in the areas of education and health.

With reference to child abuse and neglect, please provide disaggregated data (by age, sex and types of violation reported) for the years 2005, 2006 and 2007 on the following:

(a) Number of reported cases of child abuse;

(b) Number and percentage of reports that resulted in either a court decision or other types of follow-up, including prosecution;

(c) Number and proportion of child victims who received counselling and assistance in recovery.

In the area of adolescent health, please provide data for the years 2005, 2006 and 2007 (by sex, age group, and –if possible– urban and rural area) on the rates of early pregnancies, sexually transmitted infections, drug, alcohol, tobacco, and other substance abuse, suicides and other mental health problems.

Please specify the criteria for determining the poverty line and indicate the number of children living below that threshold. In particular, please provide such information relating to minority groups, especially Roma and people living in remote areas.

Please provide data covering the last three years on the number of children involved in sexual exploitation, including prostitution, pornography and trafficking, and the number of those children who were provided access to recovery and social reintegration services.

Part IV

The following is a preliminary list of major issues (which does not contain issues already covered in Part I) that the Committee may take up during the dialogue with the State party. They do not require written answers . This list is not exhaustive as other issues might be raised in the course of the dialogue:

The State party’s strategy to significantly strengthen the overall implementation of the Convention (National Strategy on Child and Family Protection) with particular attention to the general principles of the Convention, including articles 3 (best interests of the child) and 12 (respect for the views of the child)

Civil rights and freedoms

Children deprived of a family environment (alternative care, including the situation of children leaving the institutional system and children affected by migration).

Domestic violence (including corporal punishment, and sexual abuse).

Children with disabilities (including programmes and services, inclusion in society, access to facilities).

Basic health and welfare, access to health services, adolescent health (e.g. suicide), mental health.

Alcohol and substance abuse.

Standard of living (levels of poverty, including the results of the Poverty and Policy Impact Reports).

Education (including availability of qualified teachers, adequate facilities, school attendance and dropouts, early childhood education and secondary education).

Economic exploitation, including child labour

Trafficking and sexual exploitation of children.

Administration of juvenile justice , including the minimum age of criminal responsibility, diversion options, conditions in juvenile detention facilities, follow-up for recovery.
