List of issues to be taken up in connection with the consideration of

the second and third periodic reports of KAZAKHSTAN (CRC/C/KAZ/3)

The State party is requested to submit in written form additional and updated information, if possible before 2 April 2007


A. Data and statistics, if available

1.With reference to children deprived of a family environment and separated from parents, please provide disaggregated data (by sex, age group, and - if possible - ethnic group, urban and rural area) for the years 2004, 2005 and 2006 on the number of children:

Separated from their parents;

(b) Placed in institutions;

(c) Placed with foster families;

(d) Adopted domestically or through inter-country adoptions.

2.Please specify the number of children with disabilities, up to the age of 18 (disaggregated by sex, age group, and urban and rural area), covering the years 2004, 2005 and 2006:


(a) Living with their families;

(b) Living in institutions;

(c) Placed in foster care;

(d) Attending regular schools;

(e) Attending special schools;

(f) Not attending school.

With reference to child abuse, please provide disaggregated data (by age, sex and type of child abuse reported) covering the years 2004, 2005 and 2006 on the following:

(a) Number of reported cases of child abuse;

(b) Number and percentage of reports that resulted in either a court decision or other types of follow-up;

(c) Number and proportion of child victims who received counselling and assistance in recovery.

With reference to the right to education, please provide disaggregated data (by sex, age group, and urban and rural area) covering the years 2004, 2005 and 2006 in percentage of the relevant age group on the:

(a) Rate of enrolment in pre-primary schools, primary schools and in secondary schools;

(b) Percentage of children completing primary and secondary education;

(c) Number and percentage of dropouts and repetitions;

(d) Teacher/children ratio and number of children per class.

Please provide disaggregated data (by sex, age group, and urban and rural area) on the number of children who are:

(a) Infected by HIV/AIDS;

(b) Affected by HIV/AIDS;

(c) Leading households because of HIV/AIDS;

(d) Orphans of HIV/AIDS living in extended families or institutions.

Please provide disaggregated data (including by sex, age and type of crime) covering the years 2004, 2005 and 2006, in particular on the number of:

(a) Persons under 18 who allegedly committed a crime and were reported to the police;

(b) Persons under 18 who were charged with a crime and those who were sentenced, and the type of punishment or sanctions related to offences, including the length of deprivation of liberty;

(c) Detention facilities for persons under 18 in conflict with the law, and the capacity of these facilities;

(d) Persons under 18 detained in these facilities and in adult facilities;

(d) Persons under 18 kept in pre-trial detention, and the average length of their detention;

(f) Reported cases of abuse and maltreatment of persons under 18 that occurred during their arrest and detention;

(g) Persons under 18 who were tried and sentenced as adults.

Please provide disaggregated data (including by sex, age, minority and ethnic group) on the number of refugee and internally displaced children.

With reference to special protection measures, please provide disaggregated data (including by sex, age, and urban and rural area) for the years 2004, 2005 and 2006 on the number of children who were:

(a) Involved in sexual exploitation, including prostitution, pornography and trafficking and the number of children provided with access to recovery and other assistance;

(b) Involved in substance abuse, and the number who received treatment and recovery and reintegration assistance;

(c) Involved in child labour (indicating the type of work);

(d) Working and/or living in the street.

B. General measures of implementation

1.The Committee would appreciate information on action taken in response to recommendations made in its previous concluding observations on the initial report of Kazakhstan (CRC/C/15/Add.213) which have not yet been fully implemented, and in particular in relation to the following:

the prevention of any form of discrimination against vulnerable groups of children and especially against children with disabilities; the prohibition of all forms of physical and mental violence, including corporal punishment, within the family, schools and other institutions; the situation of refugee children; the administration of juvenile justice; the reduction and elimination of child labour; and the increase in the number of street children and working children.

2.Please provide information about the government body or bodies responsible for coordinating the implementation of the Convention, as well as its/their mandate and financial and human resources.

3.Please provide information on cases, if any, where the Convention has been directly invoked in domestic courts, and provide examples of such cases.

4.Please provide additional information on the role of the national human rights institution and the Ombudsman, in particular in monitoring the implementation of the rights of children, and on the financial and human resources.

5. Please provide information on the content of the State programme “Children of Kazakhstan” (2006‑2011) and on whether this programme provides for the implementation of all substantive articles of the Convention and takes into account the objectives and goals of the outcome document entitled “Building a World Fit for Children” of the General Assembly Special Session on Children (2002).

6.Please provide updated information on efforts to disseminate the Convention, the State party report and the previous concluding observations of the Committee, and on efforts made to provide training on and awareness of the Convention and human rights in general to children, parents, teachers, social workers and other professionals working with and for children.

7. Please provide updated information on the cooperation between the State party and the international community, including non-governmental organizations, in the efforts to implement the Convention.

8.Please indicate the issues affecting children which the State party considers to be priorities requiring the most urgent attention with regard to the implementation of the Convention.


Please provide the Committee with copies of the text of the Convention on the Rights of the Child in all official languages of the State party as well as in other languages or dialects, when available. If possible, please submit these texts in electronic form.


The State party should briefly (three pages maximum) update the information contained in its report with regard to:

- New bills or enacted legislation;

- New institutions;

- Newly implemented policies;

- Newly implemented programmes and projects, and their scope.
