Implementation of the Convention on the Rights of the Child

List of issues to be taken up in connection with the consideration of the combined third and fourth periodic report of Mongolia (CRC/C/MNG/3-4)

Part I

Under this section the State party is requested to submit in written form additional and updated information, if possible, before 19 November 2009.

1.With regard to the plans to amend the status of the National Authority for Children and transform it from an executive agency into a steering agency, please clarify the institution responsible for coordinating the implementation of the rights of the child at the national and local levels.

2.Regarding the Law on Protection of Children’s Rights, according to which a child may lodge complaints or submit petitions, either directly or through his/her guardian or representative, please indicate to which institutions cases have been delivered, the number of cases brought before them and the outcome regarding the complaints filed.

3.Please inform the Committee on the implementation of the National Programme against Domestic Violence approved in 2007 and clarify how coordination between the ministry responsible for its implementation and other authorities dealing with domestic violence and its victims is assured. Please indicate the measures taken and relevant actions in order to raise awareness of violence against children in the family and advocate alternative practices to discipline without corporal punishment, as well as the resources allocated to the programme.

4.Please briefly provide an update on the amendment to the Family Code and indicate the measures that will be included under it, such as provisions for single-parent families, child maintenance, adoption, and the ban on corporal punishment in the home.

5.Please briefly provide information on how the State party is strengthening the mechanisms for monitoring performance and service delivery in child care centres. Indicate

progress since the 2007 inspection and study undertaken by the Ministry of Social Welfare and Labour of the aforementioned centres.

6.Regarding the national programme “Support Persons with Disabilities” and sub-programme “Support participation of children with disabilities” divided in two stages between 2006 and 2012, please provide further information on the results of their implementation so far. Indicate how the State party ensures that children with disabilities have access to support and that their family situation is also considered in this regard.

7.Please inform the Committee on policies for adolescent girls and boys with regard to leisure and cultural activities, including the allocation of public funds. Indicate the relevant facilities available in urban, suburban and rural areas, and whether the cultural backgrounds and mother tongues of children are also taken into consideration.

8.Please indicate the specific measures taken to address, in a sustainable manner, education, including: (a) the high drop out rates, especially of boys; (b) gender, rural/urban, and income disparities; and (c) the diminishing quality of education.

9.Regarding the studies conducted on the situation of child labour in Mongolia, please inform the Committee whether any follow-up measures have been taken to address the extent and the root causes of child labour, in particular regarding hazardous forms of child labour.

10.Please indicate the policies and programmes being implemented to address the situation of street children, including assessment of their situation and root causes. Indicate any laws or national policies in place to respect the rights of street children.

11.With regard to the administration of juvenile justice, provide information on the existing socio-educative measures or alternatives to detention, recovery and social integration. Indicate the content of training curricula for judges, prosecutors and law enforcement officials, including training on the provisions of the Convention and its implementation.

12.Kindly indicate which child-related issues the State party regards as being of a high priority and warranting its utmost attention with regard to the implementation of the Convention.

Part II

Under this section, the State party is to briefly (three pages maximum) update the information provided in its report with regard to:

•New bills or enacted legislation

•New institutions

•Newly implemented policies

•Newly implemented programmes and projects and their scope.

Part III

Data and statistics, if available

1.Please provide disaggregated statistical data (by sex, age groups, ethnic groups, urban and rural areas) covering the years 2006-2008 on the number and percentage of children under 18 living in Mongolia.

2.In the light of article 4 of the Convention, kindly indicate the respective budgetary allocations, including their territorial coverage by provinces (aimags) and their trends (in percentage of the national and regional budgets), for the years 2007, 2008 and 2009, for the sectors of health, education and social protection, and for the relevant institutions dealing with children. Please explain the decrease in budget allocations to the health sector.

3.Please provide disaggregated statistical data (by sex, age groups, ethnic groups, urban and rural areas) covering the years 2006, 2007 and 2008:

(a) Rates of maternal and infant mortality (including under 5 and neonatal);

(b) Rates of immunization;

(c) Rates of malnutrition;

(d) Number of deaths by accidents (in particular, traffic accidents);

(e) Children infected with and/or affected by HIV/AIDS;

(f) Suicide rates.

4.Please provide disaggregated data for the years 2006, 2007 and 2008 (by age, sex, and professional activity) on the number of children under 18 involved in child labour, formal and informal sectors.

5.With reference to child abuse, please provide disaggregated data (by age, sex, and types of violations reported) for the years 2006-2008 on the cases of child abuse reported, the number and percentage which have resulted in either a court decision or other types of follow-up, and the number and proportion of victims who have received counselling and assistance for recovery.

6.With reference to the right to education, please provide disaggregated statistical data (by sex, age groups, ethnic groups, urban and rural areas) covering the years 2006, 2007 and 2008, in percentage of the relevant age group on the:

(a) Rate of functional literacy, under 18 years of age;

(b) Percentage of children completing primary and secondary education;

(c) Percentage of children in non-formal education programmes and training;

(d) Ratio teacher per children and number of children per class.

7.Please provide available disaggregated data on children (including by sex, age groups, and crime) for the years 2006, 2007 and 2008, in particular on:

(a) Persons under the age of 18 who have allegedly committed a crime, reported to the police;

(b) Persons under the age of 18 who have been sentenced, and the type of punishment or sanctions related to offences, including length of deprivation of liberty;

(c) Detention facilities for persons under the age of 18 and these facilities’ capacity;

(d) Persons under the age of 18 detained in these facilities and the number of persons under the age of 18 detained in adult facilities;

(e) Persons under the age of 18 kept in pretrial detention and the average length of their detention;

(f) Reported cases of abuse and maltreatment of persons under the age of 18 occurring during their arrest and detention.

8.With reference to children deprived of a family environment and separated from parents, please provide disaggregated data (by sex; age groups; urban, rural and remote areas) for the years 2006-2008 on the number of children:

(a) Separated from their parents;

(b) Placed in institutions;

(c) In foster care;

(d) Adopted domestically or through intercountry adoptions.

Part IV

The following is a preliminary list of major issues (that does not contain issues already covered in Part I) that the Committee may take up during the dialogue with the State party. They do not require written answers. This list is not exhaustive as other issues might be raised in the course of the dialogue.

1.Harmonization of national legislation with the Convention.

2.Monitoring of the implementation of the Convention.

3.Role of non-governmental organizations and civil society in the implementation of the Convention.

4.Data collection.

5.Disparities between rural and urban areas, especially with regard to access to health, education and social services.

6.Civil rights and freedoms.
