Implementation of the Convention on the Rights of the Child

List of issues concerning additional and updated information related to the initial report of Montenegro (CRC/C/MNE/1)

The Committee may take up all aspects of children’s rights contained in the Convention during the dialogue with the State party.

The State party is requested to submit additional, updated information in writing, if possible before 2 August 2010, not exceeding 30 pages .

Part I

1.With reference to the Council for the Rights of the Child, please specify its exact mandate and practical achievements and provide information on its coordination, monitoring and evaluation activities in regard to the Convention, its Optional Protocols and the National Plan of Action 2004–2010.

2.Please indicate whether the implementation of the current National Plan of Action (2004–2010) is being evaluated and indicate whether a new national plan of action for children is being developed.

3.Please inform the Committee of the exact mandate of the Deputy Protector of Human Rights and Freedoms in particular with regard to competencies to receive complaints from or on behalf of children.

4.Please clarify the process and criteria, if any, used by the State party to identify civil society partners who could become involved in the design of public policies, strategies and action plans, particularly in areas relevant to children. Please also indicate whether the State party is providing any financial support to civil society organizations working in the field of child rights.

5.Please provide information on targeted measures to ensure that Roma children are protected from discrimination, are registered at birth, and have access to educational, health care and social protection services.

6.Please provide updated information on the conditions of the children with disabilities placed in the Institution “Komanski most”.

7.Please provide information on the principal legislative, judicial, administrative or other measures in force in implementing the right not to be subjected to torture or other cruel, inhuman or degrading treatment or punishment. In that regard, please indicate whether there is a mechanism available to children deprived of their liberty and those confined in psychiatric institutions, where they can file and complaint related to their deprivation of liberty, conditions of detention/internment and treatment.

8.Please indicate if there is a mandatory reporting obligation, for persons working for and with children, on abuse and neglect and provide information on the number of reported cases and convictions.

9.Please provide information on the number of children living or working on the streets and on measures taken to protect them.

10.Please provide the Committee with practical information on the draft Law on Juvenile Justice and provide data and information on:

(a)Whether the State party has a comprehensive system of juvenile justice in accordance with article 40, paragraph 3, of the Convention;

(b)Whether all persons below the age of 18 are dealt with by juvenile courts composed of specialized judges;

(c)The number of children deprived of their liberty, including any form of detention, imprisonment or placement in custodial settings (art. 37 (b), (c) and (d) of the draft law).

Part II

In this section the Committee invites the State party to briefly (three pages maximum) update the information provided in its report with regard to:

(a)New bills or laws, and their respective regulations;

(b)New institutions (and their mandates) or institutional reforms;

(c)Recently introduced policies, programmes and action plans and their scope and financing;

(d)Recent ratifications of human rights instruments.

Part III

Data, statistics and other information, if available

1.Please specify the number of children with disabilities, up to the age of 18, disaggregated by age, sex and urban/rural area covering the years 2007, 2008 and 2009:

(a)Living with their families;

(b)Living in institutions;

(c)Placed in foster care;

(d)Attending regular schools;

(e)Attending special schools; and

(f)Not attending school.

2.Please provide information on the measures undertaken to promote and protect the rights of children in the context of adolescent health and provide data on:

(a)The number of adolescents affected by sexually transmitted infections, including HIV/AIDS, tobacco use and drug and alcohol abuse, disaggregated by sex and age;

(b)The number of teenage pregnancies, disaggregated by urban/rural area and by minority groups; and

(c)The number of programmes and services aimed at the prevention and treatment of adolescent health concerns, including mental health problems.

In addition, the State party may list areas, affecting children that it considers to be important with regard to the implementation of the Convention.
