I.States parties to the Convention and its Optional Protocol
As at 20 April 2012, the closing date of the seventh session of the Committee on the Rights of Persons with Disabilities, there were 112 States parties to the Convention on the Rights of Persons with Disabilities and 67 States parties to its Optional Protocol.
The lists of States parties to the Convention and the Optional Protocol are contained in annex I of the present report.
II.Opening of the seventh session of the Committee
The 7th session opened in a public meeting with welcome remarks by Mr. Ronald McCallum, Chairperson of the Committee.The Chairperson highlighted the launching of the Multi-Donor Trust Fund by the United Nations Partnership on the Rights of Persons with Disabilities, which took place in December 2011, in New York, as well as the first meeting of its Policy Board, which took place late in March 2012. The Fund will finance development projects whose beneficiaries are persons with disabilities. The Chairperson expressed the satisfaction of the Committee by the decision taken by the General Assembly in late December 2011 to authorise the Committee one week of additional meeting time, which will be added to the September sessions of the Committee, allowing it to process at least four State party’s reports per year. As the backlog of States’ reports pending to be considered has not ceased to increase, the Committee is considering requesting additional meeting time to the General Assembly. The Chairperson welcomed the representatives of Microsoft, Middlesex University and AbiliyNet who conducted an accessibility assessment of the meetings of the Committee. He also thanked the International Disability Alliance for providing webcasting to the public meetings of the Committee.
The opening statement of the Office of the United Nations High Commissioner for Human Rights (OHCHR) was delivered by the Deputy High Commissioner, Ms. Kyun-wa Khan who briefed the Committee on the most recent developments of the treaty bodies that had taken place since the Committee’s 6th session, such as the first meeting of the Committee on Enforced Disappearances, and the adoption by the General Assembly of a third Optional Protocol to the Convention on the Rights of the Child allowing individuals to submit complaints about alleged violations of the Convention and its two first Optional Protocols to the Committee on the Rights of the Child. She also referred to the most important developments that had taken place in the field of human rights and disabilities, such as the establishment of the Multi-Donor Trust Fund by the UNPRPD, and the Human Rights Council resolution on the right of persons with disabilities to participate in political and public life. She furtherpresented updates on the treaty body strengthening process, including information on the outcome document of the “Dublin II” meeting on the strengthening of the treaty body system, the High Commissioner’s initiativeto prepare a report on the matter, and the launching of an open-ended intergovernmental process on strengthening and enhancing the effective functioning of the human rights treaty body system by the General Assembly.
The Committee reviewed and adopted the provisional agenda and tentative programme of work of the seventh session (CRPD/C/7/1).
The Chairperson reported on the activities undertaken between the sixth and seventh sessions of the Committee.
III.Membership of the Committee
The list of members of the Committee indicating the duration of their terms of office is contained in Annex IV of the previous biennial report (A/66/55). All members attended the seventh session.
IV.Working methods
The Committee discussed various issues related to its working methods including, inter alia, the following:
(a)Functioning of the working groups established by the Committee;
(b)The feasibility of holding of a day of general discussion in April 2013;
V.Elaboration of general comments
The Committee accepted the resignation of Ms Edah Maina as Chairperson of the Working Group on a general comment on article 12, and decided to appoint Mr Gabor Gombos as Chairperson of this Working Group.
The Committee welcomed the submissions made by several stakeholders following a call for submissions in preparation of a draft general comment on article 9, under the leadership of the Working Group on accessibility
Members of the Working Group on Accessibility in public transportation and airline policies met with representatives of the International Aviation Transport Alliance (IATA), a private organisation of member airlines, to discuss about the treatment of persons with disabilities by airlines.
VI.Activities related to the Optional Protocol
The Committee considered its first individual communication under the Optional Protocol, no. 3/2011, H.M vs. Sweden (CRPD/C/7/D/3/2011). The author of the communication, which suffers from a degenerative disease which severely impairs her ability to move, requested without success that the Swedish authorities grant her a permission to build a pool in her property for rehabilitation purposes. The author alleged that she was discriminated against by States’ authorities which failed to take into account her rights to equal opportunity for rehabilitation and improved health. The Committee adopted by consensus its Views thereon, finding violations to the right not to be discriminated, the right to health and the duty of States parties to provide rehabilitation. The Committee requested follow-up information to the concerned State party on measures taken to implement the Committee’s views.
VII. Other decisions
The Committee adopted the report of its sixth session (CRPD/C/6/2).
The Committee took a number of other decisions, which are listed in annex III of the present report.
VIII. Future sessions
The 8th session of the Committee is scheduled to take place from 17 to 28 September 2012. The 9th session of the Committee will be held from 15 to 19 April 2013. The Committee will hold its 10th session from 2 to 13 September 2013.
The Committee decided that, at its next session, it would review the initial reports of China (CRPD/C/CHN/1), Argentina (CRPD/C/ARG/1) and Hungary (CRPD/C/HUN/1), and adopt List of Issues on the initial report of Paraguay (CRPD/C/PRY/1).
IX.Cooperation with concerned bodies
A.Cooperation with United Nations organs
On 16 April 2012 (64th meeting), the Committee met with the representatives of WHO, WIPO, the UN Department of Economic and Social Affairs (UN DESA), OHCHR and, UNICEF to discuss ways of cooperation, as provided for under article 38 of the Convention.
B.Cooperation with non-governmental organizations
At its 64th meeting on 16 April 2012, the Committee was addressed by representatives of the non-governmental organizations Human Rights Watch, the International Disability and Development Consortium, and the International Disability Alliance.
X.Consideration of reports submitted in accordance with article 35 of the Convention
During its seventh session, at its 66th and 67th meetings held on 17 April 2012, the Committee considered the initial report by Peru (CRPD/C/PER/1) submitted under article 35 of the Convention, and at its 73rd meeting, it adopted concluding observations on that report (CRPD/C/PER/CO/1) (See the webpage of the seventh session at http://www.ohchr.org/EN/HRBodies/CRPD/Pages/Session7.aspx).

Annex III
Decisions adopted by the Committee during its seventh session
The Committee decided to endorse the outcome document of the Dublin II meeting on the strengthening of the treaty body system.
The 8th session of the Committee will be held from September 17 to September 28, 2012. The Committee will consider the initial reports of China, Argentina, and Hungary, and will adopt the list of issues of Paraguay. The 9th session of the Committee will be held from April 15 to April 19, 2013. During this session the Committee will consider the initial report of Paraguay, and adopt the lists of issues regarding Austria, Australia and El Salvador. The 10th session of the Committee will be held from September 2 to September 13, 2013. The Committee will consider the initial reports of Austria, Australia and El Salvador, and adopt the list of issues regarding Sweden.
A half-day of general discussion will be held during the 9th session, in April 2013 on the subject: "Women and girls with disabilities".
The Chairperson will send a letter to the Chairperson of the Human Rights Committee expressing the views of the CRPD Committee regarding General Comment n.25 of the Human Rights Committee.
The Committee decided not to postpone the consideration of the initial report of Hungary.
Mr. Gabor Gombos was appointed as Chair of the Working Group on article 12.
The Committee decided that, in principle, it would endorse the draft guidelines on independence and impartiality of members of the human rights treaty bodies.
The Committee decided to request UN Conference Services to make all possible efforts to ensure that International Sign Interpretation and captioning are used in all public and private meetings of the Committee.
The Committee decided to appoint Mr Hyung Shik Kim as rapporteur for the dialogue with China.
The Committee decided to request the General Assembly additional meeting time, This decision was made in accordance with rule 22 of the rules of procedure of the Committee on the Rights of Persons with Disabilities.
