Implementation of the Convention on the Rights of the Child

List of issues concerning additional and updated information relating to the consideration of the second periodic report of Andorra (CRC/C/AND/2)

The State party is requested to submit in writing additional, updated information, if possible before 2 August 2012

The Committee may take up all aspects of children ’ s rights contained in the Convention during the dialogue with the State party.

Part I

In this section, the State party is requested to submit its responses to the following questions (30 pages maximum)

1.Please specify which body is responsible for coordinating the implementation of the Convention on the Rights of the Child in the State party. Please also provide additional information on the mandate, composition, budget and activities of the National Children’s Commission; and please clarify the relations between this technical commission and the coordination body.

2.Please specify whether the National Plan of Action for Children, mentioned in paragraph 890 of the report, has been approved and implemented. If so, please provide information on its content, including its aims, implementation budget and implementation monitoring and evaluation process, including indicators established to this end.

3.Please provide information on the impact the economic crisis has had on the budgets devoted to the implementation of the Convention. Please also specify whether there are any protected strategic budget lines for children, even in the event of an economic crisis or emergency situation.

4.In view of the recent extension of Raonador del Ciutadà ’ s field of competence to include monitoring implementation of the Convention, please provide information on the mandate and the activities of the Ombudsman’s office created in the Raonador del Ciutadà. Please indicate in particular whether children may themselves file individual complaints, whether they are told how they could do so and whether special procedures are in place for processing their complaints. Please also indicate the human, financial and technical resources allocated for monitoring and protecting children’s rights to the Raonador del Ciutadà Office.

5.Please provide information on concrete measures taken to:

(a)Eliminate patriarchal attitudes and entrenched practices and stereotypes that perpetuate discrimination against girls;

(b)Change negative societal attitudes towards children with disabilities;

(c)Protect marginalized or vulnerable children, especially migrants.

6.Please indicate what measures have been taken to implement the Committee’s previous recommendations (CRC/C/15/Add.176, para. 19) to develop a comprehensive system of data collection implemented on all areas covered by the Convention. Please specify whether the social observatory mentioned in paragraph 121 of the State party’s report has been put in place to collect and analyse data.

7.Please specify whether the State party’s legislation explicitly bans all forms of corporal punishment in all settings, including domestic and alternative care. With reference to paragraph 22 of the State party’s report, submitted in 2010, to the Human Rights Council (A/HRC/WG.6/9/AND/1, para. 22), regarding the 13.37 per cent increase between 2008 and 2009 of cases of children at risk of abuse and negligence, please indicate how the State party analyses the reasons of this rise, and the root causes of child abuse and negligence.

8.Please explain the measures taken to combat and prevent domestic violence, be it physical or psychological, including domestic violence against women, and to ensure full protection of children against this form of violence.

9.Please provide information on support measures for families living in the State party, so that all children, including children with disabilities, can live and be brought up in the family. Please provide details on social benefits for families, and all specific support given to vulnerable families.

10.Please provide information on the situation of children of detained parents and on measures taken to maintain parent-child links in an environment that nurtures their relationship.

11.Please specify whether the Qualified Act on Immigration of 14 May 2002 provides for a family reunification procedure for temporary workers and, if so, what measures are taken to ensure that such applications are dealt with promptly, taking the best interests of the child into account. Please also indicate the measures taken to give children of seasonal workers effective access to medical care and school attendance.

12.Please provide up-to-date information on measures taken to bring legislation into line with the Optional Protocol to the Convention on the Rights of the Child on the sale of children, child prostitution and child pornography so as to ban all forms of child trafficking for any purpose. Please also provide detailed information on services and support programmes specifically tailored to child victims of trafficking and sexual exploitation.

13.Please provide up-to-date information on measures taken to abolish situations of dual criminality in cases of extradition and prosecution of offences committed abroad, referred to in the Optional Protocol to the Convention on the Rights of the Child on the sale of children, child prostitution and child pornography.

Part II

In this section, the Committee invites the State party to briefly (three pages maximum) update the information provided in its report with regard to:

(a)New bills or laws, and their respective regulations;

(b)New institutions (and their mandates) or institutional reforms, and their financing;

(c)Recently introduced policies, programmes and action plans and their scope; and

(d)Recent ratifications of human rights instruments.

Part III

Data, statistics and other information, if available

1.Please provide disaggregated data (by age, sex, socioeconomic situation and ethnic origin) on:

(a)The number of married children aged between 16 and 18 and children over 14 who have married with a judge’s permission;

(b)Allegations of abuse and violence against children (including all forms of corporal punishment), with additional information on the type of assistance given to them and the follow-up provided, including prosecution of the perpetrators and the sentences handed down;

(c)The number of children deprived of a family environment and the types of placement facility (residence, foster home and/or an alternative care facility) catering for such children;

(d)The number of children with disabilities and the type of disability, as well as the proportion of such children:

(i)Living with their families;

(ii)Living in institutions;

(iii)Placed in a foster care;

(iv)In mainstream education;

(v)Educated in specialized institutions;

(vi)Out of school;

(e)The number of reported cases of economic exploitation of children, including those working within the family context;

(f)The number of street children;

(g)The number of reported cases of sale of children, child prostitution and child pornography, detailing the number of investigations, prosecutions and convictions;

(h)The number of child abductions and illicit transfer of children abroad; and

(i)The number of complaints received since 2008 by the Ombudsman, the nature of such complaints, the follow-up provided and the compensation awarded to the children.

2.In addition, the State party may draw up a list of the child-related areas it prioritizes in the implementation of the Convention.
